First time BMW owner regretting it! Help?

No the motorplan ran out in April. The salesman did however tell me that the car did till end September. When I phoned BMW to find out they informed me that it did not.

When I confronted the dealer they asked me if I got it in writing, wich I obviously did not.

It has 97 500km and i got it on 94 900km

Hey there

Word of advice, when it comes to purchasing from non-approved dealers. Always have the VIN number run through the Motorplan system at an approved BMW dealer to confirm MP expiry date and for any noteworthy comments. I never accept any verbal info about MP, they must confirm in writing or printout from MP system, as the sales staff are not in a position to confirm MP dates and do not have the systems to verify, they always will confirm through a BMW dealer if an active MP contract is loaded on the system.

If you had it in writing maybe you would have had another leg to stand on to return vehicle. You could have purchased knowing the plan is in the last month and wanted to have a few items including the jerking seen to under MP, but obviously if it was already expired then this would not have been possible.

I drove that car today, and one of the clutches are problematic. No errors have been logged. Driving away slowly in first, you can feel the clutch engage, slip out and then engage again. Under hard driving it's less of an issue.

Update:

I sent the car in yesterday to JSN. I gave the workshop manager permission to take my car home so he can experience it in traffic.

This morning he told me that he thinks it is a minor problem and that there are a few changes he will make to the transmision it self as it feels like the clutch doesnt calculate correctly when to take and when to let go and it is very intermittent.

He will drive the car home tonight again to chec if this solves the probelm.

Please dear God let it be that simple! :cry:

Hope they get your car sorted.

Man, it sucks that you had to go through all of this with a car that's New to you. It's this kind of stuff that puts people off a brand permanently.

Rather brave of you letting the workshop manager take the car home.

My 2c would be to take the car back to the original dealer and get a full refund, if possible, rather than constantly get messed around between BMW and the original dealer.

There are plenty other DCT 135i's on the market. There's actually one for sale on the forum currently. Purchasing from a fellow forum member is often more assuring.

I got the car back yesterday.

Whi I collected it I was told that they reset the clutch and gearbox defaults and that the problem is sorted now. They also informed me that if the problem returns the next step would replacing the gearbox. I got a quote of R183 000.00 excluding labour!

I drove it back to Pretoria and as i was starting to go about my day the engine light came back on. I turned the car off and it was gone when i stared up and has not returned since.

The shifting is alot better but it still jerks and now and then and I also felt it shift/grab/release yet again while i was standing still just with my foot on the brake.

I have gotten the IDA involved and I will phone the dealer on Monday to request a full refund. I dont how ever want to lose the finance on the vehicle but rather keep it in place so I can go pick another 135i.

Does anyone know what penalties I will pay? I feel I should not pay any as I gave them ample oppertunity to repair the mistake.

Thoughts?

hectic!

being across the border from you guys, i've only ever heard good things about JSN. i really thought those guys were the bees knees with BMW's.

Sent Top Gear Auto an email requesting them to replace this BMW with another DCT from one of our forum members. Since the DP was so aggro to me when I just got the vehicle and told me "You are not dealing with a Mickey Mouse operation here! Whats the problem I will take the vehicle back" I basically just asked nicely that I would like to take him up on the offer.


No reply. I have an apointment to see the DP and manager tomorrow. I am taking a family member with that is a DP himself and knows the legal part of the motor industry. Plus he is a DP and Lawyer.

I was really hoping they would just be happy to be rid of me and take the car back and replace it. They might not make profit but at least they can do something else with the car.

As tempting as it is, rather keep a cool head if possible. I just hope that he follows through with his offer then! Keep us posted!

From all of the above I see despite your problems that you are quite taken by the BMW, glad to see you have become a BMW fan :clapper:

Well we went to the dealer and turned up 30min earlier than was arranged. As I predicted the DP was not availeble and was out buying cars.

We met with the manager and he told us that we had to deal with the 3 R's.

Repair, Replace and then only Refund. We agreed and asked him nicely that we have lost all confdence in the vehicle and we would like him to replace it with a different BMW.

He said he would speak to the DP and would get back to me. Needless to say that was the last time I heared from him. In the meanwhile the problem with the gearbox has returned and now also a engine light comes one that shows there is a problem on the servos or something of the turbo.

So will drive it till the 14the and see how bad i can get it to send it back to the dealer and have JSN tell them they have to replace gearbox and perhaps even turbo.

We will see how it goes.

I think it's time you contacted your finance house and explained to them that you are tendering return of the vehicle. In fact email the DP and finance company together. In that email set out in detail all the steps you've taken to cooperate with the dealer. Finance company may back you up to return the vehicle because they have an interest in the car. It's their security for your loan at the end of the day. I think you got it wrong about being obliged to give them opportunity to fix it. I think it may be your discretion to allow them the opportunity to fix it.

Especially if it's your only vehicle.
