Spoke to Nic at Top Gear. After I told him to calm down and settle his tone we aggreed that it is acceptable for him to source a second hand gearbox. They are having it sent to JSN to certify the gearbox so that it is fine and up to BMW spec.
They will then fit it to my 135 and give me a year warrenty on the gearbox. This will set them back around R50 000.00.
I feel this is fair as I get a replacement and a 12 month gurantee wich is more than I would have in the first place.

I really don't get why you still have this car? So many excuses from the seller, but nothing justifies them selling you a dud.

1. fit me a brand new turbo from bmw.
2. Refund me in full.

They will probably fix it and that means they will have spent over R100 000 On the vehicle since I baught it. I will have a car with a new clutch and flyweel. New radiator, new tyres and new turbo. This will also include 12month warrenty on the turbo and gearbox recon.

As long as it gets the problem sorted? Or it might just be a software issue?
On a side note, after this, you'll probably end up with a more mechanically sound example than others that are on sale.
Hope it gets sorted man and you're able to finally unlock the full potential of the 135i, these are really awesome cars to own.
