Well we went to the dealer and turned up 30min earlier than was arranged. As I predicted the DP was not availeble and was out buying cars.
We met with the manager and he told us that we had to deal with the 3 R's.
Repair, Replace and then only Refund. We agreed and asked him nicely that we have lost all confdence in the vehicle and we would like him to replace it with a different BMW.
He said he would speak to the DP and would get back to me. Needless to say that was the last time I heared from him. In the meanwhile the problem with the gearbox has returned and now also a engine light comes one that shows there is a problem on the servos or something of the turbo.
So will drive it till the 14the and see how bad i can get it to send it back to the dealer and have JSN tell them they have to replace gearbox and perhaps even turbo.
We will see how it goes.
I think it's time you contacted your finance house and explained to them that you are tendering return of the vehicle. In fact email the DP and finance company together. In that email set out in detail all the steps you've taken to cooperate with the dealer. Finance company may back you up to return the vehicle because they have an interest in the car. It's their security for your loan at the end of the day. I think you got it wrong about being obliged to give them opportunity to fix it. I think it may be your discretion to allow them the opportunity to fix it.
Especially if it's your only vehicle.

Unfortunately this is fact. Confirmed by my brother in law who is a DP himself, the IDA and Ombut.
I have already contacted the IDA and MFC two weeks ago and lodged a complaint against Top Gear Auto. Both notified me last week that they are busy investigation on my behalf. Had a long phonecall to the IDA guy that was assigned to my case. He told me that unfortunately they will have to investigate and look at a solution that is fair to both parties.
All I can do now is send the car back till they fix everything or get fed up and refund me.
