First time BMW owner regretting it! Help?

Well we went to the dealer and turned up 30min earlier than was arranged. As I predicted the DP was not availeble and was out buying cars.

We met with the manager and he told us that we had to deal with the 3 R's.

I think it's time you contacted your finance house and explained to them that you are tendering return of the vehicle. In fact email the DP and finance company together. In that email set out in detail all the steps you've taken to cooperate with the dealer. Finance company may back you up to return the vehicle because they have an interest in the car. It's their security for your loan at the end of the day. I think you got it wrong about being obliged to give them opportunity to fix it. I think it may be your discretion to allow them the opportunity to fix it.

Especially if it's your only vehicle.

Unfortunately this is fact. Confirmed by my brother in law who is a DP himself, the IDA and Ombut.

I have already contacted the IDA and MFC two weeks ago and lodged a complaint against Top Gear Auto. Both notified me last week that they are busy investigation on my behalf. Had a long phonecall to the IDA guy that was assigned to my case. He told me that unfortunately they will have to investigate and look at a solution that is fair to both parties.

All I can do now is send the car back till they fix everything or get fed up and refund me.

Update -

I am working though the IDA now. The dealer does not communicate to me anymore. Called twice to ask for feedback. Called the dealership and the manager and DP would not take my call.

Having the IDA talk to them noe. They want to come fetch my vehicle to get a second opinion.

Just incase someone missed the name of the dealer with this fantastic service its TOP GEAR AUTO.

Hi RJ,

So from what I gather from this is that it is the dealer and the service that sucks, it is not the BMW's fault for the bad service :thumbs:

Look I love the car. But at this stage the BMW was at a BMW dealer twice for the repairs and they have not fixed it or been able to pinpoint the cause.

So so far i am not impressed with the brand in terms of service and ability to detect a problem and fix it.

Update -

The vehicle was picked up on Tuesday to be sent for a second opinion on the gearbox. As per usual the pickup was scheduled for Monday a week in advance. Needless to say Monday at 17:00 I got feedback by Top Gear: "Oh sorry we did not have a vehicle availeble"

Update -

The vehicle is currently at some place that does gearboxes. They have determined that the seecond clutch needs to be replaced and will do so. Costing the dealer R20 000 apparently. They also told me that this problem was the reason why the EML comes on and cuts power to the engine.

Should take 5 to 7 working days to be done.

Just want to say thank you for constantly keeping us up to date!:clapper: Wish this matter is resolved quickly and more importantly suitably as per BMW standards!

Bmw's are beautiful cars RJ, some guys own these cars with little issues, just like you about 6 years ago i bought my first bmw , e46 automatic transmission, i still have the car, unfortunately i purchased a lemon and it has cost me lots of money over the years to the point of converting the car to a manual transmission, reading your story i am so reminded of my experiences, my humble advice sir, when your journey is starting of like this, it may be safer to walk away from this car and get a refund...hope this helps

Booked in for service at JSN this week. (if they ever decide to call me back). Hope I'm not gonna regret it.

TOP GEAR AUTO are not responding. Sent them a mail Wednesday, called on Thursday and rejected my call with a response to call me later. Friday phoned the morning, manager not in so left a message for a call back. Phoned the afternoon, he was with a client so left a message with different sales rep for a call back.

Still no call back. Sent an email detailing this to the manager and also the case rep from the IDA. Was promised written feedback yesterday.

Sent a mail this morning. No response, phoned IDA rep and he promised he would get back to me. As i phoned again he is out on dealer visits and will only be back tomorrow.

Cant believe no one can help me. No one cares about the bad service. I am paying for a 135i and driving a messed up Yaris with a screeching fan belt and fender beders. ALso advertising their company with all the signage.

Sorry to hear all this crap you getting! You are trying to do things the 100% correct way and this is what happens. Total BS and once again the customer gets screwed. Really really really hope they sort this out for you, and soon, its been ages. Totally not fair.

wow that is really not cool, complete lack of accountability... No one deserves to be messed around like this when buying their dream car... Hope you come right bud

I have a on going case with the ombudsman for 14 months.
They don't take my calls or even return mails.
Got a private lawyer involved who said I should go through CPA then CPA investigated and send to ombudsman and it has been stuck there ever since.
hope you don't get stuck there like me.

Update -

The manager Nic finally phoned me back. After TWO WEEKS the gearbox place said no they cant do it BMW has to. Now the vehicle is going to BMW JSN in the morning.

I want to scream at this stage!:skit::RedNo::blueCry::cry:


Will anyone help me spread the word on this service so we can prevent people from falling into the same trap of doing business with TOP GEAR AUTO?

I posted on Facebook and on Hello Peter. Any other Ideas?

JSN quoted on replacement gearbox and the dealer rejected. Wont take or returm my calls.

Just filed a dispute with ombut.
