i have also just finished reading all of this.

it all doesn't make sense to me :sorry:

the problem with this situation is you have to spend money on lawyers to fight something that shouldn't even be an issue. i hope you can sue for any expenses incurred. good luck :thumbs:

Hope the Ombudsman turns this around for you bud.

I've heard nothing but bad news about AF. Almost took out insurance with BMW Insurance until I found out that they're actually AF.

The Ombuds promised to make a ruling so we should get a decision anytime. For me i didn't know it was AF or Guardrisk i thought it was just BMW Insurance i only knew when i got into the accident.

See when i bought the car i was always insured with Mutual And Federal no hassles at all for 5 years and they quoted me R2100 on this car but there came BMW Insurance with R999/month it was some promotion with all new cars.

Thought I would post here, instead of posting a new thread for a similar topic.
On my way from rustenburg this afternoon. Huge articulated truck goes into straight lane at t junction, I go to turn left, then he starts turning left as well, no indicators or anything. I don't have enough space to get away as this knob is now using two lanes to turn, so I climb pavement to avoid rear wheels crushing me, rear tailgate on truck catches the back of my car, pops my windshield bumper, lights, boot and pushes me down a steep embankment.

I know not to tap the brakes or the car rolls, bring the car to a stop and the knob drives off. Long story short, flatbed had to tow the car out of the ditch and I drove it to BMw ARC for quote.

Car is insured for R300k some change, damage from BMW ARC quoted at R120k to repair.

What will happen here, I need some advice from Leonard and Dez and Beaver who have had issues recently.

Is it a write off? Repair?
Assessor has not seen the car yet, so I am trying to get a jump on what I should be aware off before all of this gets rolling properly.

Shit man sorry to hear about what happened...

I really wonder somedays what these truck drivers think. Yes they a crap load bigger than you and they bully you.. Luckily our cars have decent brakes and that saved my ass a few times with trucks deciding to now join the fast lane at an 8th of the speed you travelling.

Guys, really hope you get sorted soon.. it's just sad hearing these things and thinking that some stupid asshole is the cause of damage on well looked after cars..

It won't be a write off. The damage is not 70% of the car value so they will repair.

Nope, retail isn't R300k, but my car is insured for R300k.
That is what's listed on my policy as insured value.

My previous comment remains. Damage is less than 70% of insured value. It won't be written off. They will repair.

Guys if anyone knows a tough lawyer/advocate who has worked on similar case where there is no breathlyzer results or blood tests please send me the contacts. Case is with High Court, Sheriff has issued summons already.

Seems to me insurance company's are paying people to give false statements in the case of expensive claims. This is one of 2 cases on the forum already. Something fishy is definitely going on.

As far as I know "you are innocent until proven guilty" so in my opinion the insurance should take you to court if they don't want to pay. :nonono:

I would go to court and demand an polygraph on the tow truck driver and if he is found guilty then charge him also. They need hard evidence to prove you were drunk. So if you hit your head in an accident and you are dazed then the tow truck driver can say you are drunk? Is he a doctor? Well as far as I know the police accident report is what should be used.

You are 100% correct. For me they initially tried overspeeding and negligence and tried to get my car keys after they had returned the car to me. Ombuds told them overspeeding and negligence are not relevant in view of the wide cover in terms of the Motor Policy, so they explored the drunk driving at all costs. This car is a write-off and they have to replace with a brand new car.
Will pursue the court case now.
