Crashed F30 on road pavement

For an update, Guardrisk who are the underwriters sent through the repudiation letter. Thanks to Leonard (http://www.dentdocbb.co.za/) for his assistance in collecting my car from Hallmark.
Basically the tow truck driver and his wife wrote 5 pages of an affidavit under oath alleging that i was drunk contrary to what the police saw that there was no suspicion at all that i was drunk. So this is it a brand new car driven for 2 months and a total loss of R400k for an alleged statement which is not proved by real evidence despite the fact that the scene was attended by SAPS.

+1, you can sue them for damages, a claim cant be refused on basis of hear say and not facts.

Exactly, that's my argument with them. SAPS was at the scene the entire time up to when the car was towed away. There was no suspicion raised by SAPS on the scene but this came up as an after thought between discussions of the investigator and tow truck guy.

This actually sends chills down my spine, just looked at my policy. I have a BMW insurance policy underwritten by Guard Risk Insurance company that is a division of AF. Has anybody other then DEZ had issues like this with them? Hope things get sorted out DEZ!!!

It was painful reading what k@k your insurance co is dishing to you. Soon they will tell you your laces weren't tied and that's what caused the crash.

Airbags your in for 50k,

Panel and paint about 10 to 20k

Suspension about 50k

Thats 120k (im guessing here, would like if you can report back if I am accurate or not)

However, you may have a clause in your insurance that if the car is under a certain age (1 or 2 years I think) and under a certain miledge (35k I think) that you can ask for a new vehicle in return.

@ Dez , Really Sorry to hear of your situation.

I don't see how a tow truck drivers statement can cause a claim to be rejected when there was police on the scene and taking your statement .

I say either way the tow truck operators have some sort of financial gain and I won't be surprised if the tow truck drivers are incentivised by the insurance companies to make reports and statements for some sort off compensation.

You already have a lawyer ,so half your battle is won already. I would say go to social networking sites, Hello peter, create your own blog and tell your story. You will be surprised who will respond.

Also contact the Ombudsman and lodge a complaint.

I agree with this statement, I made a complaint about wesbank on hello peter a few years back and I got some very good results from it so its worth a try.
