Short and sweet:
2012 520d MS bought from a dealer (nonBMW) , FSH (at agents), 101000kms. 10 days later while doing 80kmph, motor goes (conrod/crank)
Will BMW replace the engine?
WIll BMW cover the costs of repair?
Must the dealer cover the costs? (CPA)
Must the dealer cancel the deal at the bank?
Should the dealer give a different car?
What are your thoughs please

This is for the dealer who sold you the car to resolve... u have 6 months to get them to resolve it/replace it or refund you. after that you wont be able to cry CPA.

is it on extended motorplan? if so... just go get a brand new engine from BMW??
Otherwise... get your money back from the dealer, probably only achievable via CPA

If the service history of the car is blemish free with MP, and given the mileage at only 1000km out of MP, involving BMW may be prudent. This would be with a long term strategy of including them for a possible contribution through goodwill in mind.

BUT I would get the full MP history first before talking to either the dealer you bought from or BMW.

The CPA requires only that they repair first then only replace (if I understand correctly). Do you really want a repair which may amount to a Japan auto engine swap?

If you can get out of the sale altogether that may be first prize unless the car is otherwise immaculate and the service history is sound.

You are covered by the CPA. It's solely your choice whether you want the vehicle repaired or returned to the dealer for a refund. I think if BMW carries out the work then it's a good idea to keep the vehicle. If not I think let the vehicle go.

UPDATE!!!
BMWSA have approved a replacement engine due to MP and service plans and good will.

WOW!! Thumbs up to them!
was pretty sure BMW will not fit responsibility after Mplan expired.

According to the guy at BMW this was a very rare occurance

Dealer to foot the labour bill but thats small change.
New engine was R146k labour was R14600
Dealer happy as a pig in sh1t

Yeah agree with this , its happened straight which unfortunately to say is great. I would push for the dealer to pay for the repairs but through BMW least you know the work will be done right and warranty on parts.
