Ultimately though, I reckon go the leag l route. The consumer commission is swamped with work and has little resources, it may take up to 2 years to sort this out.

Dont be afraid of the media & hellopeter. BMW is all about image, and they wouldn't want bad publicity.

private sale should not make any difference as long as the standard quality check was done by BMW - which is a prerequisite for the transfer of a motorplan

HI ALL . GOT SUM NEW INFO REGARDING THE MOTORPLAN .
I APPROACHED BMW WITH ALL THE INFO STATING THIS HAPPEND BEFORE I PURCHASED THE CAR AND EVEN THOUGH MOTORPLAN WAS TRANSFERED ON MY NAME AT A MILEAGE OF 29500KM . THIS OVEREVED INCIDENT TOOK PLACE AT 25820KM . THEY SAY THEY ARE NOT RESPONSIBLE AS THE CAR WAS BOUGHT PRIVATELY AND NOT THRU A BMW DEALERSHIP. I HAVE TRIED TO REASON WITH BMW BUT NOW AM LEFT WITH NO CHOICE . IM HANDING ALL THE DOCS OVER TO THE CONSUMER PROTECTION ACT.

Good luck Bro...you have a case they should resolve in your favor.
