Bud I suggest calling the Motor Industry Ombudsman...

Ultimately though, I reckon go the leag l route. The consumer commission is swamped with work and has little resources, it may take up to 2 years to sort this out.

Dont be afraid of the media & hellopeter. BMW is all about image, and they wouldn't want bad publicity.

private sale ouch... going to be an uphill battle unless you had it checked out by BMW before purchasing the car and have a report that it got a clean bill of health...

private sale should not make any difference as long as the standard quality check was done by BMW - which is a prerequisite for the transfer of a motorplan

Have you called BMW Motorplan directly yet to state your case or just been dealing with the dealer?

HI ALL . GOT SUM NEW INFO REGARDING THE MOTORPLAN .
I APPROACHED BMW WITH ALL THE INFO STATING THIS HAPPEND BEFORE I PURCHASED THE CAR AND EVEN THOUGH MOTORPLAN WAS TRANSFERED ON MY NAME AT A MILEAGE OF 29500KM . THIS OVEREVED INCIDENT TOOK PLACE AT 25820KM . THEY SAY THEY ARE NOT RESPONSIBLE AS THE CAR WAS BOUGHT PRIVATELY AND NOT THRU A BMW DEALERSHIP. I HAVE TRIED TO REASON WITH BMW BUT NOW AM LEFT WITH NO CHOICE . IM HANDING ALL THE DOCS OVER TO THE CONSUMER PROTECTION ACT.
Good luck Bro...you have a case they should resolve in your favor.
