I think your best option is to go the the dealer you bought it from and let them try fight it, bmw doesn't care about you are me. we will always loose and I also have first hand experience that bmw doesn't care about their customers

Car was definitely tuned and returned to stock before being sold to you. I had the same thing happen to me with an E92 335i, I got the dealer who sold it to me to pay for a MP inspection and the MP was re-instated. See if you can take this route.

I've been reading this and it's not a nice thing. Just realized you bought second hand and this is where the tune/mod must have been done. Agree with going to the dealer you bought from or just enjoy the car and let BMW do basic services etc and not drivetrain related things. My car is out of plan for almost 2 years and still really solid. No issues at all.

This really is a crappy situation. I would suggest going back to the dealer you bought the car from. It was a selling point for them that the car still had motorplan which I'm sure they factored into their price when advertising it.
If they can't sort it out for you perhaps you can still get a partial refund.

The above responses cover the issue properly. If at ANY point, the car was tuned, then you have a problem. WEIRDLY though, this is something that is checked when the car MP is transferred from the seller to you with the BMW 1 million point check. oddly it doesn't seem this was identified when buying, but now after owning and driving for a year. IF the tuning flag is dated before your car was sold to you and MP transferred, then actually this isn't your problem as the Mp check/inspection should have identified this, so thats the argument to use to fight it. If the tuning flag is dated after you took ownership and had the car inspected at BMW to transfer the MP, then you have some explaining to do.

if you think they will not void MP, you would be wrong, guys have had MP voided for spacers as mentioned above, steering wheels, non approved exhaust tips, non approved led light bulbs and i have even heard of MP voided on cars because of coding non-factory options on the cars which created faults in the electrical system which threw errors when plugged in for an oil change.

Get the dealer on your side to help.

from then, we should see a lot of "cheap" low mileage BMW's for sale, due to it. Will never buy a new one without plan.

The PDF you attached from Gavin Crocker means that have picked up engine tuning. Either by flash tuning or a CAN-BUS Integrated piggyback like JB4. No doubt about it. Arguing with them is pointless.

any thing done to the car, they can pick up like anything, rather read the terms and condition of motor plan contract and stick to it or try a BMW without a plan or warranty works out cheaper then buying a car gonna suspended with plug and play mods,aftermarket exhausts and and and

so basically only buy used BMWs on Motorplan from BMW...otherwise you can get screwed over if there was software etc on car with previous owner and BMW miss it with moving over the Motorplan.

no bud before buying any BMW make sure a Quality check transfer of motorplan is done this is a must be done before it will be transferred to your name (this has been going on since the flinestones) the moment you put that car on Ista the plan will be suspended so buying a BMW without a quality check done EISH

rather contact your nearest dealer and inquire about transfer of motorplan before buying a BMW

and query about the motorplan

so just for clarity...i won't know anything on the matter of Motorplan but im going with what was said above about it being checked when the MP was transferred and it wasn't identified.

You don't have to avoid buying cars at third party places, but buying any car without a check that YOU pay for at the manufacturer is not a good idea. Places that check the car out themselves or pay for checks themselves are bad news. If there are any things that need to be attended to, do it BEFORE you have signed any documentation. I paid those school fees before, but fortunately the lesson has saved me many more times since then. If there is a motorplan to be transferred then the sooner it is done the better. If it is like Merc and the plan is 'with the car' rather than on your name, it is STILL worth the effort getting the check and all clear done in writing by them.

aaaahhh ok so when the MP is transferred you have to get the car checked BM dont check unless you instruct them...ja then i agree i would def get it checked.
