sorry guys have been really busy never had a chance to update this thread. matter was handed over to my lawyer the other day, awaiting answers now. To the guys that said i should pay for the repair from my own pocket! Would you pay 300 000 for something when you never did anything wrong not even a miss shift and not even doing software on yr car? Would you pay 300 000 for following bmw's rule and regulations and watch them try and screw u over for it?

If I knew I didn't do something wrong I would go the same route. Try keep good record of communication with them and try keep it electronic and not verbal.

Tongue in cheek. Tongue-in-cheek is a phrase used as a figure of speech to imply that a statement or other production is humorously or otherwise not seriously intended, and it should not be taken at face value. The facial expression typically indicates that one is joking or making a mental effort.[1] In the past, it may also have indicated contempt, but that is no longer common.[2] By 1842, the phrase had acquired its contemporary meaning similar to "take what I am saying with a grain of salt", indicating that a statement was not meant to be taken seriously.[3][4][5] Early users of the phrase include Sir Walter Scott in his 1828 The Fair Maid of Perth. If you did not miss shift, or otherwise abuse it then why should you pay. Hopefully with all the electronics in a car now they should be able to determine the exact circumstances that caused the over rev and you should be alright.

+1, when nothing is wrong, everything is peachy... Now something needs to be change, 180 turn around:argh:

Quite simply, they have to show you a print-out of the over-rev scenario, similar to the pic George Smooth posted. Unless they can do this, they don't have a leg to stand on.

If you know you didn't money-shift it, you should be just fine.

Sorry guys, haven't been on here in ages. And the updates are as follows:

1. Car repaired by a friend of mine who is a bmw specialist.
2. Cost me 60k of my own money, thankfully my friend didn't charge me labour.
3. I didn't go to court with bmw because my lawyer advised me not too as he did a similar case to mine before this and he said after proving car was not modified, bmw claimed that the vehicle was miss used and abused and I could very well be wasting a 100k by going to court. So used the same money to repair my car.
4. After this event with my vehicle, my friend who repaired my car and I started paying attention to the e9x m3 and already came accross 11 m3's with. Bearing failure, 3 of which bmw has repaired and 8 motorplans kicked out.
5. When I went into the dealership to pick up my car and take her home for repairs, a F10 M5 arrives on a towtruck with bearing failure at 14000km.
6. All my friends and I have moved away and most of sold or currently still selling our bmw's and will never touch the brand ever again.
7. I'm happily taking delivery of a mercedes cla45 next year.
8. Bmw called me up asking if I'd like to test drive a new M3 when it arrives and that called ended nasty.

And last but not least, if any bmw technicians or anyone from head office is reading this thread, I'd just like to say, your'll all are a bunch of a$$hole$$

Thanks to to everyone for their support and advise, I appreciated every bit of it.

I would move away too if this was the case, in general I think all new BMWs are built quite poorly - speaking from my own woes with my F30.. :nonono:
Hope you enjoy the CLA - they are amazing looking cars!!

Sorry about your problems experienced with BMW lately. Owing a few BMW's especially M3's, I/we didn't experience any major issues. The M3 doesn't get drive much but gets hammered every time its out, as I've mentioned before.

With regards to the bearing issues, i don't know where you've got your info from but I've not come across them here in SA. The few that where plagued where from the US and these cars were mostly tracked and when they had their motors opened up to get a stroker kit done by Dinan, little scuffs were picked up on the crank. No failures as such.

Hence BMW have changed the bearing after 2008. Even if you own a pre2009 model ESS only RECOMMENDS you change the bearing and its not necessary to change them when supercharging.

Had a proper look at the CLA recently? Build quality isn't up to scratch. The bonnet even uses an old style metal rod to hold it up WTF. Panels are very flimsy. This I didn't even note this, my cousin who has owned Merc's all his life picked it up.

Sorry to hear, but yeah is probably cheaper to fix it yourself, there's no winning against corporate company like that:yuck:

Congrats on your new car:thumbs:

When I wanted to buy an e90 M3, at least 2 had their big end bearings replaced under motor plan, so it must be an issue on the V8.

Someone who works at bmw once told me that the m3 V8 is one of bmw's most sensitive and weak engines. these engines are not tolerable to hard damage, which I find hard to believe. Its just strange that a V8 M3 cant take abuse like how the e46 or e36 m3 use to take. BMW engines are becoming more powerful but their tolerance is becoming less.

Well I've owned bmw's my whole life and I other cars also. My e36 m3 never had an issue, my 330ci never gave an issue, my e46 m3 spun a bearing and I never claimed on that coz the car had engine mods done to it and now this shit with the e92 m3. None of my mercedes ever let me down! Non of my toyotas ever let me down either. Bmw's build quality is either exact to mercedes or I'd not worse! But never better! My e92 is 2008 january model, bmw changed the part numbers of bearing in mid 2008 but never did a recall on my car. A friend of mine had a diff claim on his e92 and first they gave him the story like they did me and after argueing then they said miss use and abuse. Point is even if bmw is like a rolls royce infront of mercedes or any other brand for that matter, they don't stand by their products and loyal customers like us! I personally won't buy another and if I do, I would buy a cheap one without motorplan coz paying 300k extra for a car on motorplan is still like driving a bmw without motorplan

@demon - I dealt with auto umhlanga bru but it wasn't the dealership that gave the issues it was headoffice. The dealership even called head office and told them that they know the car and the car is standard and unmodified and they shouldn't give me crap about it but headoffice didn't wanna hear it. Hey yr car looks exactly like mine now with the wheels. Remember when you came quarry rd, you asked on the hannaford wheels thread whose car that was, well it was mine bru.
