e46 handbrake

I have a 320d E46 - I can't get the handbrake to hold properly - nor can BMW ! - I really have to give it a "ruk" to get it to hold on even a minor slope - on a moderate to steep slope - forget it.
They say that the following is normal : If I come to a stop uphill and put the car in gear (to park it) - when I come to move off, I put my foot on the brakes, and knock it out of gear (clutch in) to start the car. The whole car will immediately fall backwards a tad. Feels just like floating discs on a motorcycle when the discs are cold or the rivets worn. Is this related to the parking brake or the whole system - should it be so ?? is it standard BMW ?
