i would demand the following if you decide on them replacing the car:

they must allow you to keep the 335i as a loan car until they take delivery of a replacement car with the exact specs of the dud they sold you. if they get one with higher specs they can give to you at same price as current one or you are happy to wait and put mileage on their loan car

Ok the consumer Act states as far I know they must replace it with a new one with the same spec or if not available one with a higher spec and they must carry the cost. thats facts phone them. So the new car comes make sure to read before you sing. Inspect the car before you sing and take a witness or 2. Yes and keep the loan car till you get the new car.

Dont pay them a cent extra!!!!!!

I just want my money back now.

They mess me around then give me a higher spec option and I must pay the diff.

I have the M135i until a replacement.

This has become a joke of a brand to deal with.
Although I love the brand, they just don't wanna make their customers happy.

Time to give Lexus, Merc, Audi or VW a chance.

Dont give up the law is on your side. get the new car and refuse to pay the diffarance and you tell them . lets go to court and see who wins. you will see they will drop it just there

While I understand your frustration, I think that getting new M135i and keeping it is great.
Its a new, untainted car, clear of any of the bad connotations you have to the existing one.

Drive "your" current M135i until you get your new one. Be patient and don't give in to their bullying to get you to pay in.

If they don't have your exact spec, I believe you have every right to put you in the priority queue to get a new one built to spec. Unless of course they can give you a 0km one of a higher spec, without having to pay more.

Remember, your car will get a new set of tyres with it.... so tyres on the current car are there to play with :rollsmile: (I hate these huge smileys...)

i would most definitely not drive the original dud m135i around. give that back to them. you just need to have a fender bender or something and then a whole lot of new problems will arise. please, give it back to them, you dont want it. its their problem.

Yes I agree fully. dont mess it up now, rather give it back to them at once for they will be smiling if you mess that one up. They are clever very clever.

This brings back so many memories. In 2006 I decided to move away from BMW brand as BMW SA, in their infinite wisdom, decided to make me pay for replacing the catalytic converters (around R30k) on a new BMW 745i, after they have been struggling for 6 months to find a problem with performance of the car. Their reason – they did a fuel contamination test and found unacceptable levels of metal in the fuel. Response from fuel companies was that BMW is taking a chance, but not one of them was willing to stand beside me though. Result was that after having owned 10+ BMW’s I sold my wife’s BMW 530D and my BMW 745i and went to another brand. 7 years later, and I could not resist the new M135i. Great car to drive. Glad you got sorted and didn't loose out like I did. BMW cars are great but it seems the bureaucracy is still very much in control!

- Opel OPC (They showed no interest in selling me a car)
- Auris 2012 D4D/TRD
- If BMW 320i/d (I had to ask to speak to the sale person, not much interest shown in the customer or a sale)
