Waiver regarding CPS claims

The other point the dealership made is that the vehicle goes for the AA test and that all problems that exist will be identified and resolved before the vehicle is sold. This implies that all known issues would be identified and resolved.

I have seen some of the 'AA' test centres.., and theres no way they can pick up all existing problems.

That x1 looks sweet bud. never heard of this dealership before.

They are in PTA on Johan Heyns Drive( dealership drive) lol. I dont expect it to have issues, as the MP is clean, one owner car, no accidents, no repairs, not even touch ups, so a scratch it had.., is still there.

Hi Sash

The AA testing station does not have the diagnostic equipment to check electronic faults, etc...They will do a basis visual check and in most cases this check is as useless as the piece of paper it is written on...
If I were you I would check previous comments on MP as this vehicle looks like it went of the MP 3000km ago, So you can get a pretty good feel for what was done, also if vehicle was in an accident it would have been recorded.

To give you a feel of what an AA test means, I bought a Fortuner from a non Toyota dealer and they gave me the AA test which passed 100% - no remarks.
Before purchasing vehicle, I put the vehicle on a lift, in front of the salesman and showed him that the brakes were nearly metal on metal and that the rear wheel cylinders were leaking. I asked him how this car passed Roadworthy and the AA test, he couldn't answer me. The dealership however did fix the items and I was a happy man thereafter.
So please dont just take for granted that you getting a 100% mechanically and electronically sound vehicle.
My suggestion to you, if you really interested in this vehicle, arrange for the vehicle to be inspected by an independent Workshop and based on their findings you will have all the necessary information (together with MP history) before purchasing/signing OTP.

Hope it works out for you....Good luck

Thanks for the feedback guys.

So i contacted RMI who confirmed what was said above, but with the mention that a consumer should not expect every issue to be covered by the supplier for those 6 months as some issues can developer after the fact, which i agree with.

I found the clause in the CPA that says
Unfair, unreasonable or unjust contract terms
48. (1) A supplier must not—
(a) offer to supply, supply, or enter into an agreement to supply, any goods or
services—
(i) at a price that is unfair, unreasonable or unjust; or
(ii) on terms that are unfair, unreasonable or unjust;
(b) market any goods or services, or negotiate, enter into or administer a
transaction or an agreement for the supply of any goods or services, in a
manner that is unfair, unreasonable or unjust; or
(c) require a consumer, or other person to whom any goods or services are
supplied at the direction of the consumer—
(i) to waive any rights;
(ii) assume any obligation; or
(iii) waive any liability of the supplier,
on terms that are unfair, unreasonable or unjust, or impose any such terms as
a condition of entering into a transaction.
(2) Without limiting the generality of subsection (1), a transaction or agreement, a
term or condition of a transaction or agreement, or a notice to which a term or condition
is purportedly subject, is unfair, unreasonable or unjust if—

I spoke to John @ Leo Haese who is willing to assist with an inspection at my cost if I can get the vehicle to him. I am trying to arrange this if possible.

I see Northcliff Executive cars also advertises their cars (which are out of plan) subject to a compulsory warranty purchase. They also have in bold PRICES NOT NEGOTIABLE. I wouldn't go near such dealerships, just seems like they want to rip you off. A personal view though as the fact that they still in business means people are supporting them, but why?

Either cars that guys believe are 'perfect for them' and they believe it is worth the purchase despite the BS from the dealer OR those genuinely terrified by the sales pitch accompanying a car without plan or warranty.

How many dealers sell the pitch of 'motorplan extension will cost 75K+' or 'can't be done' and 'this warranty covers the same as motorplan'...

Even here on fanatics there is so much misinformation around motorplan and extensions thereof that I've heard over time... it is an easy lever for these dealerships to use to their advantage.

I've been looking into this and it seems that there is an implied warranty for 6 months after purchase wherein the dealer can replace, repair or refund.
