Waiver regarding CPS claims

Hey guys,

I am in the process of looking for a vehicle and the one dealership I am in talks with mentioned that they have a 2 year warranty that is added onto the purchase price. If you choose not to take their warranty then you sign a waiver which states that I have waived my right to the CPA and they dont have any obligation to resolve any issues I might have with the vehicle.

So if where does this leave me.., R13k for a 2 year warranty, that I dont really want, but if i dont, they wont entertain any issues?

The warranty shouldn't be what they rely on to honour CPA responsibilities. They will use this to weasel out of anything and tell you to just claim from warranty anyway.

I out of principle, will do everything I can, to walk miles around businesses that operates in this manner.

100% agree. Do report this to the CPA also. Stop them bullying other consumers. CPA was put in place for these exact crooks

Heard the same crap from franchised dealers, it is of twofold benefit to them....kickbacks on the warranty and cover in the event of an issue with the car....

I politely declined the warranty offer, advised I will purchase the vehicle on my terms or walk away...

Got the vehicle with no warranty or delivery and registration fees....full tank of fuel included...stand your ground or walk away. Dealerships/sales people often push these fees on unsuspecting buyers...it is not written in stone.

Only problem is, although CPA looks good on paper their actual track record is kak.

So, even if you might have a case(by not taking the warranty, then going to CPA if something goes wrong), chances are nothing will happen in anyway.

CPA has a specific anti waiver clause so even if you sign a waiver it has no effect in law. i.e the waiver is meaningless and you still get the 6 month implied warranty. third party warranty is more to cover the dealer than you. They are scum for making it compulsory though. If I was buying a second hand car I will only buy a warranty after 6 months as the dealer has to cover the first 6 ,moths ITO CPA B

So i got the info from the dealership. Essentially the form states that they advised you to take a warranty and if you decline the offer you are purchasing the car wholesale ( As-Is). While the deal in my opinion still a good one with the extra amounts added ( R20k above what was advertised) I can still get my own warranty at a lesser cost. Will neg with them to see what happens. They are sorting out some issues I picked up when i viewed so I will decide when i go to view again.

Sash, a dealer cannot sell a car "as is" or "voetstoots" as of the implementation of the CPA, no matter what they say. Only private deals between individuals can sell vehicles "as is" with no cover from the CPA.

I would not give this dealer the benefit of a profitable transaction. They are attempting to rip you a new one.
