Looking for a way out if I think, also, I'm not too clued up on the engine control dynamics of the platform, but surely if it was running lean this would of caused knock/detonation and forced the car to over-fuel for protection ? bmw's are famous for going into limp mode as well so surely something would have triggered that too before catastrophic failure?
Also fuel quality varies from place to place, and the cars are made built to cope with that?
have they even opened it up if they are suspecting a melted piston? or tested the oil level sensor? It seems like they are going the extra mile the cheap way from the comfort of a desk to avoid having to use man-hours to investigate the failure. Too much effort for them to drop a sump or pull a head it seems...
