She is not... her boy friend whisked her away from the accident scene and he claimed he was the one driving... :argh: Now my Insurance cant claim third party cause he arranged for the car to be towed away before I could even get her details and when the police got there I was all alone.

In any case, as long as you got the number plate, it should not be an issue with the car being taken away. In fact, it may work in your favour, as it would be seen as a hit and run. However, I'm sure the more legally inclined guys can provide more info and advice.
Just make sure you report it at a police station and provide a description of events and drivers. If the car was registered in the female driver's name, it would be up to her to prove she was not driving at the time, and not your problem.

Dammit dude, this is terrible.
There is no way in hell that there is 96k damage on that car, unless it damaged the rear wishbone. and even then....

My brother has a 2010 Merc C200k that was rear ended by a golf. From what you can see, the bumper is buggered, the boot lid is stuffed and possibly some work on the rear fenders, that is all you can see.
The car has been written off. The diff took a hit and with all of the electronics and sensors in the diff it is uneconomical to repair the car if it needs a new diff.
With the current prices for parts from the F8cking SOB dealers I would agree that there could be R100k damage on that car.

I only have the number plate of the car that took the driver from the scene... The conquest was towed away before I could even take the reg down... I blame the bloody tow truck as they agreed to remove the car from the scene before Metro could even get there. The conquest had not yet reported the accident to the Midrand police station so I think the lady was drunk. The insurance also dont want to write the car off as its insured for 200k and my settlement is 148k so they will be inclined to pay me back a lot of money should they write it off... I am now taking legal advice to for the insurance to write the car off as the diff took a hard knock.
If you take Leagal action against the insurance Via insurance Onbudsman it will prolong things .... they will only w/off the vehicle if the damaged is more than 70% of the Retail value ....which in your case its not.... so they wont w/offf the vehicle

Last week some idiot bus driver decided not to stop at the robots because they weren't working and smashed into a corolla and dragged the car about 15m...the car was stuck under the bus when i drove past. Think the driver died on the scence and his daughter is in hospital, critical. Bad part for the bus driver, the women in the car is a police officer, so hope he gets whats coming to him, bloody idiot!!!!
