OK, so heres the story of how my pristine sapphire black bmw 320d E90 LCI has been damaged.
Saturday night, my wife and I take a drive to my cousins complex. Having been there before, I know the visitors gate is only wide enough for a mini, since my front bumper was knicked before by the complex gate and every viosit after that, i have insisted that they open the residents gate for me.
So, i get to the complex, with my cousin in her Z4 in front of me, she opens the gate, drives in, gate starts closing, she presses tghe button and it opens, i drive in and next thing i Know

The gate closes on the passenger side between the tyre well and the door, scrapes into the metal and pushes the side marker inside the slot.
I get out, gate is still trying to close, the security guard comes out of the "box" puts it on manual and opens the gate.
So clearly the sensor isnt working, I mean the whole point of the sensor is to "sense" that something is interrupting the beam and not close, as a protection measure to prevent damage to cars and loss of life, but it malfunctioned and closed on my baby! :cursin:
So, we tell the guard, WTF dude, why did the gate close, he says they have been having problems with the gates at teh complex for a while and tghe chairman of the body corporate is aware and they are trying to fix it. So, they say, they have to complete an incident report, 10 mins later, the security company supervisor arrives and concurs with me, that the gate shouldnt be closing if something interrupts the sensor.
So, the incident report is completed, and I leave the scene with the Estate Managers Contact details.
Call her yesterday morning, and she says, no we dont have a problem with that gate (when the security guard told me of 2 other units who have had the same issue), and the fact that the visitor gate has already closed on my car. She says, I advise you to inform your insurance and we will advise ours as well. she says put everything down in an email and send to us, and we will respond.
Shes trying to be sticky! :cursin:
I take the car to Lyndhurst auto, the quote is R10k!
She responds to my complaint this morning to say:
"Dear Man whose beautiful car has been damaged by our faulty Gate,
I refer to our conversation this morning and than you for addressing the issue in writing.
As mentioned, please lodge a claim with your insurers.
Without any admission of liability, we will instruct (Company), the managing agents of the estate to do likewise on behalf of the estate.
Please let us have your insurance details and your full particulars.

anyway, i have to see if they are going to pay, since it isnt my damn fault, why should my insurance pay?
