Well according to Wikipedia a stock E46 M3 can do 308km/h once delimited.

It's geared to do about 261kph at the rev limit in fifth gear. A 3.8 would obviously be faster. It's not geared as astronomically as the 540i, which would pull about 304km/h if it could rev to 6500 in 6th gear.
