The CPA unfortunately cannot be used here at the car was purchased in September 2010 and the Act was introduced in April 2011.

Actually called the MIOSA today, the reply was that unless i have proof in writing and that i can independently verify from a specialist that i have a car than i won't really have a leg to stand on.

Looking into the CPA option now, i have a friend who know's someone so hope i get a reply from them soon.

That sounds exactly like the noise i have but coming more from the front of the car, can't believe that this is an issue not being addressed by BMW, just a major :nonono: in my books.


Thanks for all the replies, i have alot of calls to make and running around to do to try and resolve this matter, have gotten some really good info out of all of this more than trying to search on the net for assistance that is for sure.

I will upload the video of the noise later this evening but very similiar to the earlier post by Philip Foglar and one thing i have learnt is that BMW SA are sly, they don't reply to emails or put anything on paper and only make verbal agreements.

Yesterday the customer service agent was quick to blast a dealership via email and copied me on it to make it look like they are not delaying the process and that the dealer was at fault but that wasn't the case.

I think it's best to name and shame these guys so that anyone in this site should know that if you speak to that person they are not to be trusted.
