Good evening everyone,

As many of you know, we’ve had some issues with our E90, which have now been resolved. We're now looking to replace it with a 320i F30 and have found a great option at WeBuyCars (WBC). After multiple inspections, including one by BMW, everything seemed in order. However, dealing with WBC has been a challenge.

My parents are trying to purchase the car on finance, and it's both A-rated and Platinum-rated. BMW has approved the vehicle's condition and offered a warranty. Despite this, WBC is refusing to sell the car, claiming the terms of BMW’s warranty are unclear. Instead, they are pushing my parents to purchase WBC's own warranty, even though BMW’s is superior.

Initially, WBC agreed that if an external warranty (in this case, BMW’s) was better, they would accept it. Now, they are going back on this and pressuring my parents by saying there’s another interested buyer, threatening that they might lose their deposit if they don’t move forward.

We want to proceed with the purchase, but only with the BMW-approved warranty, as originally agreed. WBC is now unwilling to facilitate the sale, citing unclear warranty terms. My parents are ready to pull out and demand their deposit back if WBC doesn’t honor the initial agreement. It’s frustrating because it feels like WBC doesn’t actually want to sell the car, which is ridiculous.

The bank has already approved the finance and confirmed the car’s condition. They’re waiting for the invoice from WBC and are satisfied with BMW’s warranty. Yet, WBC is causing unnecessary delays, despite everything being in place.

This situation is baffling. The bank, BMW, and my parents are all on the same page, but WBC keeps making excuses, even claiming there are other buyers interested.

WBC just contacted my parents and said they’ve removed the reservation, citing a lack of clarification from BMW on the warranty (which was fully explained) and an increase in buyer interest. That they have another buyer in the showroom with them. They’re silent about refunding the deposit, and my parents will be going in on Friday to resolve this. Something about this just doesn’t feel right.

I have no doubt the WBC warranty has very nebulous terms in it. It is not up to WBC to dictate the warranty if the bank is happy. The ONLY thing that matters is that the finance house is happy. The warranty and the 101pt check is for THEIR benefit. as they carry the risk WBC carries no risk other than 'normal' CPA stipulations as this is a financed deal (moot since the vehicle will essentially have a warranty).

Someone wants to earn comm on the warranty sale. You can lodge a dispute with their customer care/dispute resolution. I know one of the fanatics has followed this route and they very quickly begin to toe the line and it can even result in disciplinary action/termination for the sales staff trying this (very different scenario though).

IANAL but it is very unlikely your parents will lose the deposit as WBC are the ones that are terminating the deal and your parents have fulfilled all the terms on their end.

Just make sure that you and your parents document EVERYTHING related to this and request all comms in writing. This in and of itself is sometimes enough to resolve these situations as the staff will be quick to talk/threaten if it is not at risk of being on the record.

Unfortunately when you become a monopoly, customer service is no longer a top priority. What is the cost difference with the 2 separate warranties? BMW warranty is the obvious choice

R500 difference.

Unfortunately this sounds exactly like what I think it is: some floor salesman chasing every peanut thrown at him... simultaneously trying to hit a target so he can stay on. If you escalate it, this will likely get resolved.

I am not a fan of non-motorplan warranties but if you're getting one OF COURSE the manufacturer one is the way to go! It makes absolutely zero sense to entertain them.

Yeah, they are the one's that terminated it, not us. They have to return the deposit. We're going to take screenshots of the WhatsApp chats, and note the emails. WBC changed their WhatsApp to expire. So WE'RE GOING TO DOCUMENT everything. So ridiculous.

The whole WBC argument about BMW warranty is that it is not clear and that the client has to wait 30 days for approval on it. BMW then replied saying that there is no such thing, and warranty is active the moment it is signed. WBC wants it on paper, BMW says it is already there, and what else can they put???

Geez, it's not even worth it for your parents to consider.. rather walk away and something else will come along
Yeah. BMW warranty is clearly better. We're going to see now if they will even give the deposit back. Now tmr BMW most likely wants us to pay the R1800 service cost for car inspection. Something will come. Either a new BMW, or we will just get like a Suzuki or Toyota to supplement the current E90.

Simple. They have a buyer willing to pay more, however the deal is sliced. They are trying to weasel out to improve their bottom line.

Yeah, skelms. Now we're trying to get back our money. So maybe now the next guy or gal is going to get a good deal on a "BMW approved" condition of a 320i with 44,000kms perhaps.

But it is going to be a loonngg...frustrating process in getting our money back. They are just going to make us tired and give up on the claim.

Yeah. It's going to be interesting to hear their excuses. They sent a WhatsApp to my parents after the phone call, citing "I’ve been informed that the vehicle has been in a reserved status for too long. BMW has been unresponsive to my emails regarding the warranty. I copied you into the last message regarding feedback. However nothing. So vehicle will have to be unreserved unfortunately."

I don’t think this is going to be as difficult as it seems. It’s a big org. Once customer care gets involved it won’t be long (I mean like 7 days vs few weeks). They have no leg to stand on to retain the deposit and everything seems documented.
