Call their bluff and ask where is the car... I can almost bet you, that they dont or never had it! This will give you leverage to use against them, that they never procured the car to sell to you in the first place.

Lawyer up and show them that you wont be bullied, go as far as telling them they owe you interest on the money they have been witholding of yours.

Before you do anything further, please ensure that you have logged a case with BMWSA regarding this dealership , if you bank with FNB, you can formally log a case of dispute, but you have to be able to prove that you a) you received no goods from them and b) that you have made attempts to retrieve your money after 30days.

OK, So I called BMW customer care, no help. I called BMW Finance, no Help.

spoke to MIOSA and they say that the dealership actually can claim up the cancellation fee on the car but that could be a couple of grand.

Just got off the phone with BMW Group and they are going to call the dealership and try and resolve this and get there side of the story.

Anyone here a good lawyer?

I don't think you will need the lawyer. Seems like they trying to sort it out. If you don't come right with a lawyer let me know. I know of a really good one.

Thanks mate, that's what the lady at BMW Group said. She said once she has lodged a complaint I should formally send them an email stating that ive spoken to BMW group to assist in resolving this. In that same email I am going to state that if a face to face meeting is needed I would prefer to bring a lawyer just to make sure I'm covered as a consumer.

just wanted to let you know I spoke to the dealer principal of Zambesi and we have come to an amicable gentlemen's agreement. and the issue has finally been resolved.

Great to here man. 100k is a lot of hard earned money.

On the bright side, BMWFanatics is in the process of forming a strong relationship with a dealer in JHB, from which members can benefit with purchases ranging from new cars, to used and parts. We should have some news early January. This should make it easier for our members to get things done with a dealership where we hold some weight.

Either way, they only resolved because you put up a fight.
I wouldn’t trust that dealership . Period.
I am of opinion they would have screwed u good and solid if you let them.
Well done getting your money back.

I happy you sorted bud, but TBH this shouldn't have been an issue in the first place. Daylight robbery if you ask me. Honestly now a days is becoming hard quality to find. :dunnoanymore:

Amicable agreement or not, the fact remains that they were clearly trying to pull a fast one. Stories like these need to be spread far and wide to ensure dealers like this one see a tangible loss in business as a result of being a bunch of dodgy f*ckers.

Yip as I mentioned in an earlier post, the most they can charge you under the CPA is a reasonable cancellation fee. So seeing that you came to an 'amicable' settlement, I presume you paid a cancellation fee? If so, how much did you pay ...
