the only way you would ever get caught according to a top tuner in the states is if bmw physically takes your car and puts it on the dyno and sees figures way above what it makes stock, but bmw would never do that.

I was contracted by 3 OEM's to fix maps on certain models for our conditions.
1. Mini for the superknock on certain models. I did 4 cars for a dealership & I got paid by BMW. Loads of these mini's had their engine replaced and the updates from BMW were not working. Very simple to eliminate knock in a map, by just retarding the ignition timing. You lose 5-10kW but you save BMW hundreds of thousands in engine claims per car.
2. Audi A4 1.8T 140kW. The infamous pinging model. Did around 7 cars before Audi released an update to fix it. But Audi lost a lot of ground in those few months where all those cars were pinging.
3. Hyundai Veloster Turbo. When they were releases, all the cars had a major flatspot at the onset of boost. This was logged with Hyundai and escalated. The Koreans said they would send a a technical team down to evaluate and make changes to mapping for African conditions, but it would take 3-4 months to do. In that period I fixed 11 cars for them and once again the checque came directly from Hyundai.
What's my point? Mapping a car doesn't mean it's gonna fail. It actually makes the engine more efficient. A map is released by an OEM to run in a large range of variables. From Death valley California with 55deg heat to Siberia with -55 deg heat. from 81 to 101 fuel. Various barometric pressure conditions.
If you car is running in a certain set of variables like Johannesburg with 95 RON, then all that "Fat" built into the map can be eliminated. It can be mapped for your conditions, your fuel, your variables with al the safety measures still in place. There's no fraud here, we actually making the car run better. When the car is mapped it's mapped very conservatively with horsepower and other efficiencies left on the table.

Tuner promises high and low it's undetectable as to not void your warranty/motorplan - stinks of trying to defraud the manufacturer (helping someone steal is still being part of a crime)
You do xxx to your car because you believe that you won't get caught and if your tuner screwed up the manufacturer will pickup the tab - blatant fraud.
Lastly some boitie from South Africa is smarter than a bunch of engineers that designed the thing not to mention countless tuners in the rest of the word, while not impossible statistically that happening is slim.
