What are my rights?

Hi Fanatics,

And so the plot thickens.

I didn't want to update this thread, but I'm at a point where I feel like it's worth going after this guy even though it's going to cost me a bit.

This morning I got some mail in the post box and low and behold, it's two fines. Both of them in Kempton park whilst the car was in his possession.

This now proves that he was driving around with my car as the car was at his workshop in PTA - Montana area. Kempton is a good 50km away. One fine for 86km/h in a 60 zone and the other for 138km/h in a 120 zone.

My insurance has advised that I have law protection added to my policy and that they will amended all the physical damage and take it up with him. That is an approach going forward, but what about the R1600 he has racked up in fines now? What about the clutch that's still not fixed?

This is the first time in 5-years time that one of my cars has gone to a mechanic, and this was the last time! I'm astonished at what damage this guy has caused to me and that he has just decided to run away.....

I do believe that this needs to followed thru to the full letter of the law

I retract my statements about "school-fees" and fix yourself

You should be able to transfer the fines into their name if you can prove the vehicle was not driven by you but rather by the mech, either by way of a signed job card or something to prove the vehicle was not in your possession at the time.

Sorry to see this bud, been following this saga since you posted.. Although I have to ask, you work at BMW and you are part of the BMWFanatics circle.. Why in heaven's name did you trust some fly-by night mechanic to sort you car? Recommendations from the forum would've helped you avoid this mess that you are in.. I have seen the posts on the BMW group and quite a few people have been scammed by this guy and are in a similar position. Seeing as though you don't let mechanics work on your car, I would've thought you would triple check just who your car is going to... Before my cars go somewhere, I do my best to research everything I can to help me make an informed decision, because I don't want to be involved in a situation like this.

I know its late to say the above but would love to understand what prompted you to use an unknown entity? Hindsight is always 20/20, so I really hope you can get this resolved and take a learning for the future.

Good Evening fellow fanatics,

I have some time on my hands and I though I would address some questions within this thread.

I've accepted what has happened and the only thing I can do heading forward is to fix the car and accept that some people just aren't meant to work on cars.

To address the questions from @"KPM3_30" - Let's be frank, it was my own stupidity and I have suffered the consequences.

Mario was recommended to my by a friend which has previously done a auto to manual conversion via Mario, and it actually came out quite good. I was strapped for time, and it seemed like the sensible option.

My insurance has come to the party and the car is going in for a physical assessment tomorrow pending approval of a close to 30k quote from Auto Magic.

I really do hope I can get these minor things fixed as I still adore my 325ti and even though this has driven me to the point of possibly selling - that would be the last option for me.
