What are my rights according to CPA

Hi guys,

Bought a pre owned 2011 E90 320i from an approved BMW dealer about 2 years ago and I’ve had endless problems with the car. Shortly after I bought the car the injectors went which the dealer replaced under warranty. A few months later when it went in for a service the dealer, whilst resetting the service lights, caused the ECU to blow - they apparently replaced the faulty ECU but the vehicle has been giving endless transmission issues since then. After many trips back and forth to the dealer they keep on saying that it’s the adaption values that need to be reset but each time after resetting the values, the vehicle is fine for a few 1000kms but then the transmission problem reoccurs (terrible jerking from 2nd to 3rd).

I eventually decided to take the vehicle to another BMW dealer, and they informed me that my gearbox “is on its way” out so they quoted me 91k on a new gearbox. I really feel that I’ve been sold a mechanically flawed car and the dealer which I bought the car from has just fixed the problem for the short term but hasn’t really repaired the actual fault.

What exactly can I do in a case like this? I don’t really know what to do anymore... the dealer keeps on insisting that it’s general wear and tear on a vulnerable component. I’ve only done just over 20,000km since purchasing the vehicle. Surely the gearbox issue was there before I bought the vehicle?

You can try to talk to them but the CPA route is only an option if you had the car for less than 6 months. Good luck tho, maybe see what you can find second hand in scrap yard or something.

2 years? You left it way too long.

The car is your own problem now. Trade it in on something else.

Take it to ZF for proper diagnostics. Fix it and trade the car. You’ll take the knock for repair costs but it won’t be anywhere near R91k.

Problem is that my E90 was one of the models that came out with the GM manufactured box so ZF can't really help me... I've tried them.

Perhaps a gearbox service would sort you out? BMW (service shop) is retarded when it comes to this.

Contact ZF and let them advise you.

Problem is that my E90 was one of the models that came out with the GM manufactured box so ZF can't really help me... I've tried them.

Speak to Nico.

They outsource the work on GM boxes.

Sorry to hear about your terrible experience :sorry:

i do however have to mention that the sh*tty shifting is a common issue among the E90's so it does not mean that you box is on its way out. not saying this is the case but the 2nd to 3rd is a common issue caused by alot of things. My gearbox that should be f### according to BMW is handeling software and she goes like a dream..besides for the odd shift here and there. Take a look at my thread and the replies on it

DO NOT TRUST DEALERSHIPS!!!!!!!!!!! i took mine in for the same thing about the shifting and they told me that my car has been in a serious accident and sensors have been by-passed and and and telling me they need to replace the entire rear diff and i cant even remember the ridiculous price they quoted:dunnoanymore::fencelook:

Thanks bud - I also read some threads on some forums in Europe and the US and it also seems like this jerking issue is a common issue/problem with the E90 auto models. It's just so frustrating that BMW don't really know what they talking about when it comes to technical issues. They simply cannot fault find, so instead they just quote to replace! :thumbdo:

maybe get into contact with rash777 on this forum

i know he also had some gearbox issues that he managed to find the problem to:thumbs:
