Someone KICKED my car - advice please.

Hey guys

I stay in a multi-phase complex.

Last night (9:15pm) I was picking up my sister from the other phase's park. Her friends ask me nicely to rev my car. I rev my car to about 3500rpm, which is pretty quiet considering I am using stock intake now..

As I am leaving, I pull off at about the same RPM, the road is wet which causes my tyres to slip a bit, but its not loud at all..

About 50m or so down the road I see this man (looked about 40) standing in nothing but his boxers in the middle of the road like a sumo wrestler.. I slow down from about 40km/h (the speed limit) to about 20km/h and try to avoid him. As I approach him closer, he starts moving towards my car.

As I pass him I see his leg lifting and hear a loud thump. After I told him what was on my mind he threatened to call security. I told him he is more that welcome (not as politely), and asked for what? (to which he did not reply.)

The thing that makes me wonder is that from the point that i was revving to the point i pulled off was about 10 seconds.. There's no way he could have got out of his house that quickly and came to stand in the middle of the road.. Which makes me think he may be a drunkard or something.. Or was outside the house for another reason...

I look this morning and there is a rather large dent on the top left back of my car on the line/contour that goes from the front of the car to the back of the car above the door handle.

Have not told the folks yet as I do not want them to worry, especially since my dad is out of the country at the moment.

Where do I go from here? Any advice is welcome. I sure as hell do not want to pay for this guys idiotic actions.. He had no right to do this.. :censored:

Look if he hadn't dented my car I probably would have let it slide....

But he did.. And he's gonna pay....

Right this is simple, you know where he lives right, so you go to the police station and you lay charges against him.
Damage to private property. You also call your insurer and tell them what happened and hand over this guys details. He will then either have to have his insurance cover your damages, and or be sued by your insurance company for recovery of costs.

Either way, he will regret kicking your car, you might have pissed him off, but it gives him no reason whatsoever to damage it. You are a lot more controlled than I am, I would have stopped right there and beat the shits out of him. DO NOT TOUCH MY WIFE, DAUGHTER, CAR. In that order :)

Thanks freerider. I am just wondering whether I should pass this past my parents first and ask for their advice..

The problem is my car is parked outside our gate as there is no space inside the gate.. So it's exposed to people that have access to the complex..

Would hate to wake up and find my car even more destroyed..

Maybe I must consult a lawyer and send him a notice to pay before going the formal charges route.. I don't know the process though.. Maybe you have to lay charges before going the lawyer route...

Only problem is lawyer = $$$ .. probably (definitely) more than the costs of repair..

You also have 24 or 48 hours to report this if you plan on claiming from insurance. Lay charges dude! You dont need to pay a lawyer for that, and I can guarantee you that pillik wont go near your car again.

I have to agree with Don. Go to the police and advise your insurance company. You have all his information and the insurance company is going to do anything and everything in their power not to have to foot the bill of fixing your car, so they will ride him for it!

My first reaction would have been to moer the oke, but your reaction was the best to go with. This way you will remain the victim!

An uh, yes, again I have to agree with Don, "Dont eat and shit in the same proximity.

You cant wait for your parents to get back especially not when you want to report this as you have to do this within the time period given by Don.

As for fear of further damage to your vehicle, only an idiot would want to cause mroe damage especially after you have reported it to the police. He would effectively be the first suspect, if such be the case, who knows an interdict....

I am trying to get the address first , working with estate security, then I will go over to the local police station.

@Hellas I am comming down with something (feeling all hot and faint at the same time), so I am sure this has allot to do with me being too calm. Under normal circumstances I would have blown more than a gasket with an oke like that.

Kicking someone's pride and joy is an abomination!!!

Call me my car is very very loud, he will be out there in a flash and when he comes out pull your car forward(as i will shoot him if he kicks by car)let him kick again and we record it! Then we shoot him! You will always get chops like that, what amazes me is that he kicked your car, which means he is an over agressive type of cock which in turn means he was looking for an argument. Guys like this normally hate it if they get a visit or letter from the boere.

Why are you beating around the bush? Go to the place, knock on the doors of the 3 hours surrounding the incident, and the first bloke who steps outside with a pair of boxers and an attitude gets an earful. Take security with you, in case he kicks you instead, and demand an explanation. Even if you just end up shouting at each other, tell him you threaten to get police/lawyers/insurance involved.

You didn't rev the car like crazy, do a wet burnout, or do this before, did you? If he was outside already by the time you drove past, it doesn't sound like you messed around for 10 seconds, if he came outside just to kick your car. Unless he was outside already, and just doesn't like BMW's.

@edrich: :rofl: haha thanks! sounds like it could be fun :) i've decided to report it to the police even though I didn't have an exact address, simply stated the street that the indicent occured on and what happened.

@major nah I didn't do any of that stuff before. You got a point there..maybe he hates BMW's :rofl:... In which case I rate we ALL pay him a visit hahaha.

So think I'm gonna wait for the case numant and take it up with my insurance from there..

Oh and btw. Club motors radburg gave me a quote off the top of his head - R3000... :/

@gizmo: was thinking the exact same thing! (minus the video/money making part). Quite a good idea :) hahahaha. Would be so classic.. He must come bare foot like last night as well! :rofl:
