SARS Question/Advice

Firstly, I hate Sars..
When you owe them money, They want it now and if you dont pay, they charge you interest every month that you dont pay. we do not get to Audit them

BUT when they owe you money, They Audit you and take as long as possible to pay you out

Here is My problem

I filed my tax return 19th July 2017 and am due a Considerable amount. I received an email from SARS advising i'm being Audited and i need to attach supporting documents

So i go ahead and attach the documents.
Its been 30 working days already and the "Still assessing it".

Their website speaks of 21 working days but when you call in, they say Audit takes 30 working days and Refund takes 21 working days. Howcome they dont pay us interest fro how long they take to pay you out??

Here is the Question
My wife is the main member on medical aid and im a Dependent, She is a Stay at home mom so not working but the payment of the medical aid i pay for. It does not come off my salary. Its paid for after.

So i attached a Letter explaining She is the main member but im paying for it, hence its in as a claim from my side. i also supplied bank statements showing the deduction of my account

Is this a Valid claim? or should i eventually expect the Thieving B$#tards to tell me they not paying

unfortunately they will look for all reasons not to pay you.

the department of defence just bought a 25 million rand jet for Zuma that you must pay for

You are the one providing the support. i.e paying for the full medical scheme, therefore you should claim the full medical credit

Thats what im hoping for
BUT, no one at the Call centre, Agents or managers can actually confirm this. Hence they told me to right the motivating letter and they said its up to Auditors to decide

I am a bit rusted on tax matters and stand to be corrected on my views.

SARS will disallow / not give the credit because you are not the main member. Sars unfortunately does not recognise substance over form and looks at issues from legal perspective. Legally your partner is liable for the medical aid contributions and Sars may actually say you are donating the funds to your partner. Luckily donations between spouses do not attract tax.

If your partner was earning an income, they would then get the deduction/ credit.

Again i am bit rusted and could be totally wrong.

After doing as you advised, Couple hours Later, i got Confirmation Email.. Audit Completed and SARS are Paying me OUT!!!!!:clapper:

@Dmonic1, You were 100% correct on this one..

Was told 48hours to 72hours for pay out to complete

I saw a news article last week where a SARS spokesperson said people must please be patient as there is a backlog they're attending to. Some payments will take longer.

So here is the correct answer!

Yes you can claim, as long as you are listed as a dependent on that specific medical Aid and that you are actually paying the medical Aid contribution

So you will need to submit the Medical Aid Certificate and a letter from the medical Aid where they state the payments received are from you and your account number, you can also attach bank statements if you wish!

I did the above with one of my new clients for 4 or 5 years that he had not submitted, all were reviewed, I didn't submit any bank statements just the medical certificate and the same letter from the medical Aid and all were accepted and the reviews finalized

Now let's say you pay your mother medical and your own, because you are not a dependent on your mother's medical Aid then you don't qualify for the deduction/credits
