No dispute. Signed the AOL in Aug.
Just waiting for payment. Its ridiculous and I'm still paying the monthly instalments on her.

I even bought another daily just to get around. Bought Tinnovittee's E36 318iS.

So my approved claim is not yet paid out I quickly phone my broker.
He tells me that Saxum is filling for liquidation....
Tried calling Saxum but nobody is picking up.
Phone the FSB and send them an e-mail explaining the situation and that if have been waiting for Saxum to pay BMW Financial Sevices SA the outstanding settlement amount for close to 4months now.

Their response is telling that look, Saxum will be in court today and that a liquidator will be appointed.

Then she tells me that if all the assets etc have been sold or whatever and they (Saxum) cannot pay out my approved claim that it will be for my own account [ANGRY FACE][ANGRY FACE][ANGRY FACE].

I mean wtf?!?!

Now I'm still paying for a scraped and parted out 320d!

The Registrar took this action because SaXum is insolvent, and he is satisfied that it is in the interests of SaXum’s policyholders that the company be placed under liquidation. Saxum’s insolvency resulted from underwriting losses due to a significant increase in claims, combined with impairments to the value of certain of SaXum’s assets. The Registrar’s decision to launch the application follows an intensive process of monitoring SaXum’s financial position and engaging with its shareholders to find a solution to the financial soundness problems. The Registrar prohibited SaXum from carrying on any new short-term insurance business from 8 September 2016. Clear deadlines were set, by which the insurer needed to be recapitalised. The shareholders of SaXum failed to recapitalise the business within these deadlines. The Registrar is satisfied that policyholders’ interests will be best served by liquidating the insurer in order to prevent the further erosion of SaXum’s assets and to ensure that creditors are treated equally and the claims of some are not preferred over others. As SaXum is insolvent, it is no longer able to pay policyholder claims or repay collateral amounts. BMWFin is not insisting I settle immediately, Saxum never bother telling them that the car was written off!

I phoned them (BMW) today to hear what can I do in this situation.
I mean the car is already scraped and parted out..so there is some breach of contract.

I suppose, but this was the one my broker actually preferred!

Moved my policy or rather my broker moved me over to Mutual & Federal

Hope we can sort this mess out asap.

I was with Quicksure and the policy was being held by Saxum, one day needed a tow truck to get my car after a breakdown. They just throwing me between phones until I ended up paying from pocket. There was no communication to me or anything that my policy had been moved from one company to the other from Quicksure.

Cancelled with them and vowed never again to go through brokers. I am very sorry for your situation buddy. Must suck paying off a car you are not even enjoying but atleast BMW is not putting pressure on you to settle. Hope they sort it out

Sorry if I missed it in this thread, but surely you are entitled to the wreck (possibly sell some parts to offset your loss), have you tried this avenue?

I am really sorry about your misfortune, no one deserves this.

Ive been in a situation where I submitted a claim into a liquidated business and there was a chance that I had to pay in money (as apposed to getting something out).

It had something to do with the amount of creditors vs the actual money available to pay creditors and fees of the liquidator. At that point I decided it wasn't viable for me to claim.

Be sure to ask about this (legislation might have changed), because you dont want to get shafted even more.
 
Hi, sorry about all you going through. If they give you the wrecked car to salvage. How much will you let go of the navigation for?
