Well I doubt I will ever see a cent from the guy because when we called him to inform him that obviously our insurance will go after him he says in a cocky manner "They can ma come."
But I am definitely going to take him to small claims, just out of pure principle.
What sucks is my excess is high because I am 20 and the fact that I have qualified as a defensive driver means nothing to them (the insurance).
In that case I really do hope that they nail him! My brother in law had a nasty accident a few years back while on the way home from a job and after dropping off his guys (private construction industry), and this was after the rugby that Saturday in the evening - so he is going through an intersection and this guy in an old Renault 5 skips the robot. Takes him off the road into a nasty lamp pole and then onto a tall kerb - and my brother in law was driving a raised body Hilux bakkie! Bakkie and Renault both write-offs!
But, the guy in the Renault was p#ssed out of his bracket, and so was his slightly injured female passenger. His car was not roadworthy for various reasons but especially the fact that the license disk had expired a few years back! So of course, not insured either! Brother in law's insurance eventually paid out, but lost his excess and also at the time just had new rather expensive tyres fitted to the bakkie.
A case was opened because this guy was driving under the influence and his passenger sustained injuries - but this is a few years on now, not really sure what the outcome was, but with your accident I would use everything you can against him! Not sure if you can open a case against him, but you should be able to take him to the small claims court at least!
I am sure there is someone here with more legal advice to offer, but since the guy has that attitude I would make it even more of a pain for him!! :thumbsup:
