E90 Charcoal Filter Delete?

So I've been on e90 post seeing quite a few threads about this. So I took my airbox out to have a look but I don't see it there?

Do only the US cars with panel filters have this Charcoal filter?

The US cars have a different air box design when compared to the European or our South African models.

They indeed have a 2-stage filter, first charcoal and then the regular filter element.
