Hi guys,

Want to tell you how my afternoon was.

So being a friday afternoon you try to relax and get into the weekend but still completing the last few things at work. Police pulls into work and we managers start phoning each other joking about them being their for the other one.

Anywho finish that joke, 2 minutes later got a call from reception. Police is here for me. Getting outside (work secure parking lot) and see the police hanging around the car I just bought a few weeks ago. I asked for a SATNAV disc as seen here

https://www.bmwfanatics.co.za/showthread.php?tid=50923&pid=1424097#pid1424097

Asking the police what is wrong and gets informed car is stolen. Remember I have all my purchase documents bought it from a car dealer and not a person. The person who claims it is stolen had 3 documents, 2 licence renewal documents and 1 sale document from him to another person. I didnt know it is this simple to claim your car is stolen, thought it involved prove of purchase etc. A lot more evidence, worse is the police arrived without a docket number. Just there to collect. Also they were very hasty to get out of there when we started asking questions. Felt wrong.

Anyway though I would share my experience of this afternoon. And to think I was looking forward to the weekend.

WTF - did they take the car then ?

No, I told them they cant remove the car as it belongs to me and their system Enatis shows I am the owner. But ya, I still have the vehicle.

Only problem is that photo's the guy showed me. Like it isnt google map ones, they are closeup ones of both work and home.

So, are they stalking you and taking photos of the car.
Are they trying to legally steal the car?

Well the home foto is only my house, no car in picture. So I think that one must be me. The work one is an extremely closeup foto. Like we have a car park inside the facility and you need to report who you visiting. Then to get to the car you will need to drive a fair bit in. You cant get this foto shot from the street outside our business. But the work one includes the exact area with the car from a closeup, which involves getting pass our security, register and this is inside a business.

Think they are trying to steal it legally by having the police as backup.

Jaare that is bloody scary. A POP from that guy should be a must including a case number if his claiming its stolen. Would be keen to hear what @Coisman would say about the procedures hsre as well as anybody with a background in law.

Surepy Fake cops surely by the sounds of it. This is terrifying.

Whilst there are processes in place, unfortunately as long as corruption exists at the licensing dept I think anything is possible.

Also want to see what our fanatics enforcement and legal people have to say

Oh, want to state this. The car is not stolen. Clear on all systems, police, enatis etc.

This individual want to report the car as stolen as he believes he is still the rightful owner. After numerous phone calls back and forth to the car dealer this weekend it appears that on both our sides, me to dealer and dealer to seller that we have legit documents. RC1 document, also note I followed the proper system when I registered this vehicle in my name at the offices. If anything was out of place it would have flagged up during all of these processes. It would not have been possible to register the car.

I do believe the individual will show up tomorrow again at my work. Just need to find out if without putting myself at risk, I can give him the details of the dealer where I purchased the vehicle from. Before the individual left on Friday he said that I must contact him and he will arrange to remove the trackers (he claims there are 2 of them in the car) from the vehicle. They have been and is still tracking me.

With the individual on first meet saying " give me my keys" and being rude about it I am not so sure to do this phone call thing. Also he gave his number to me and looking at whatsapp his profile appears blank. Cant see anything and for that I dont trust this. If I come to you claiming I have been done in or whatever and then hide my profile, why do that if you have nothing to hide.

Also the police made both of us take photo's of our ID's. If falsifying documents is so easy then this person has all my details, my home address, work address and my ID. I was hesitant to give him my ID but police being there I didnt want to seem resistant. Now I am stressing due to all of this.

Look how can someone pitch up and say that the property is theirs when it isnt. So I can sell my car and then after purchase go with the police and claim it back. All of this without an agreement between me and the individual. What is scary is that the individual said I must go with them (with the car, demanded on the car going too) to the police station and open a case. The more we asked for the case number (individual reporting it at the police) the more we are told I must go with the car to the police station.

I have been in contact with the police while this was happening, just the urgency of the police wanting me to go with them to the station and not wanting to wait for a lawyer to pitch up made it a bit suspicious. Also they demanded I must go alone with the car and with them, this is from the officer. One had a gun in his hand, looked like an R4 or something and didnt have any ID on him (name badge / rank signs, shirt was blank) they other officer had his credentials like name badge and fully clothed.

Sorry if it now sounds like I am complaining or something. I just wanted to know how come it is so easy to arrive at someones place with the police when no case has been opened and then demand the person to come with to the station. And on top of that have this it needs to happen right now urgency.

Look something feels out of place, not with the car itself (paperwork) but with this individual.

Which dealer was it? Surely the guy who claims the car is his should contact the dealer that sold you the with the police for answers?

Shit situation. Dealer should take the car back or atleast provide proof of how he got the vehicle. Also do a NATIS lookup to see that this person claiming his car back indeed owned the car before it was dealer stocked?

Something similar happened to a friend a few years ago. He left his car on consignment at a dealership, they got a buyer and submitted natis docs to transfer the car. Dealer didn’t pay him and closed down. He eventually got a portion back more than a year later with lots of lawyers fees.

Police couldn’t help because the car was legally transferred to the new owner, I’m sure the seller is buddies with the cop hence the intimidation.

It’s a terrible situation to be in but the dealer is at fault. Get legal advice and remove those tracking units.

Good luck

WOW!!!

This needs to be put on a social media platform and taken up with the authorities, make people aware of his.
Perhaps an open link to this thread and detailed description to get people to read it.

Is the car financed? Get the financing house and the dealer involved. Maybe you are still within the CPA cooling off period and can walk away from this hot mess and get your money back

Contact your insurance, they have legal cover to deal with this.

Relating to the tracker, contact a tracking company yourself, don't allow anyone else to remove the units.

Relating to the paperwork and the fact that on your side you say you have everything, don't stress.

Sounds to me as well as a scam. Might even have corrupt SAPS members involved as well, hence me going back to the first comment I made - get your insurance involved.
