E46 328i Give it back or keep it

Guys, need advice please. Have bought a 1999 E46 328i with 131k on the clock from a BMW dealer on Friday. Yesterday when i had some time i had a good look at the car and found the following:
Plastic cover over radiator leading to the air cleaner intake fixed with cable ties, left flicker loose, right flicker out of alignment and protruding the bodywork, left headlight globe holders fixed with cable ties, front bumper out of alignment with rest of bodywork (left fender sitting more inwards than right fender in relation to bumper)
Then first tried to get hold of salesman but he was at a wedding (not his, fortunately)
After i had cooled down i thought it is not that bad, i will have a go at the bumper and try and align it.
What i found was that the headlights were fixed with self tappers, broken tabs, etc. Also found that the bumper carrier onto the chassis where the collision piston are, only one bolt fastened, one finger tight and the third quite loose. On the other side i could not get the light out, saw that that light was fixed with beforementioned self tapper and still could not get it out. What it seems like is that the three bolts on the bumper carrier, only one is there that i could see and the other two it seems are loose or missing. Also found the bonnet was slightly standing up at the hinges when closed and upon investigating found the both the back screws were very loose whereupon tightening them brought the bonnet back into alignment with the body.
My dilemma is that the interior is in excellent condition, the mileage is 131k km and the motor is sweet. I would like to keep the car but am worried about what else is broken/loose/bent/etc. So, what to do now: should i return the car en ask for my money back (cash deal), negotiate about having the broken stuff fixed/replaced or should i negotiate to buy the 2003 E46 320d with 187k km for the same money. When i went to see the car the first time i asked the salesman if the car had been in an accident and he assured me that it had not been in an accident. Must admit, i did not notice any of the above at that stage.

Solo...bad news first.

Not having checked the car before putting the money down is quite frankly your own fault. Buying ANY used car from anyone must be inspected thoroughly especially a car as old as the one you purchased.

However, the glue, the screws and the ties must be fixed by the dealership asap.

I reckon you should see what the dealership is prepared to fix and what not.
Most important thing is the engine. If you're happy with that and the interior is as good as you say it is then its a mindset change you need.
It's an old car and is going to have a few issues irrespective.

Look at it as a project and not a problem.

My old E46 was the best car I'd ever owned. Loved the interior. To this date I regret selling it.

PS. 181k is a lot.

Sorry, that sounds like a classic front end accident that was fixed on the cheap. Get your money back asap

I climbed under the car and removed the covers and found that only one of the bumper nuts was halfway out, the other two were all right. Did not see any worries underneath, with no oil leaks from the engine or gearbox although there is some very clean oil next to the brand new pulley tensioner that they replaced before the sale. Part of the deal was the dealership would put the car through their 120? point plan and fix what was wrong (like the pulley and a plastic splash plate by the left front wheel which they replaced without me even noticing or asking for it to be replaced) The thing is, i like the car (had a E39 528i some time ago) and the motor is sweet, starts on the button and no funny noises. Economy seems ok, is a bit lazy when compared to my E39 530d, but am quite happy with it (the car is for my wife)
Car is really clean inside with no marks, scratches, etc. So, i think that the previous owner (a medical doctor) did not even notice the shoddy repair work and just accepted the car as is after they had it repaired.

Hey bud!

Second hand cars are a risk! Fortunately the consumer protection act does exactly that.

Speaking from personal experience, if there are faults on the car which the salesman did not make u completely aware of, you are entitled to have them repaired at the dealers cost. If you wish, you could also request a refund.

Basically all faults have to be pointed out to the buyer, and stated in the purchase agreement. There is no way that they could say they were unaware of these faults, because as you said, the dealership would have put the car through some sort of 101 point check.

Call the dealer and check it out :thumbs:

Wow if I was in your position I would want an explanation ASAP.

if damage is confined to the cosmetic items you mentioned i would keep the car and try get the dealer to fix the problems...

best would be if they can just supply the parts so you can have them fitted or DIY... I dont trust car dealers to do good repairs...

I had a few niggels with my E46 I purchased from them last year, and they were more than willing to fix all the problems 2 months after i bought it for free

Make a list of all the things and go and talk to them, Callie and Hennie have always helped me were they could

Yes, from Callie. At this stage i have decided to keep the car and have registered it in my name. I have spoken to Callie a few times about the problems and have written them a report of what i found wrong/damaged or things i am not happy about and have asked them to see if they would help me with certain parts (secondhand or new). I am waiting for a reply to my letter.
I have fixed some of the items already, but will be needing a new passenger side headlight and cradle as the present one has most of its brackets broken off. Also a passenger side flicker as the present one is very dull and faded. I hope they will be forthcoming with some or all of these items as a gesture of good faith
