Yeah well, it boils down to your car being roadworthy. If the spare wheel does not have tread on, your car is not roadworthy, and then you are automatically liable for all the damages (to both vehicles), even if someone drove into you...

Open track days at Killarney is neither of the above. There are marshals, they not timing you, its not a rally and you not racing. Killarney did a letter for the insurance stating this.

I've taken Carbon on the track monthly, for almost 3 years. The Corsa was on for about 5 years. I've never had an accident on there until now

I would start taking names, numbers and kneecaps...not necessarily in that order...

The Ombudsman was involved since March, they had no luck with insurance. They had their last meeting with the insurance on monday

oh fuck., can I say that on these forums. my heart truly goes out to you. at least you had 10+ years of joy, most than most lame ass mofo's with cars have in a lifetime.

I would assume is something is not defined properly they hold the right to interpret it as they see fit at a later stage.

Maybe I am missing something here and perhaps you can fill me in. I hate insurance companies with a passion and have personally gotten shafted by them but I honestly fail to see why every one is taking offense to this decision.

You were on a racing track, you were racing, or at very least pushing the limits of your vehicle on a track? That seems like a racing event to me?

That is like telling your Mrs that you only went to teasers because they make a great hamburger.

I am sorry to hear about your situation but come on guys, this was hardly unexpected?

the problem i have with it is...

the insurance company's are quick to not pay out on a technicality on the contract...

but now the contract does not clearly state that this event was excluded from cover and they still dont pay out...

i agree it is racing, but according to the contract it still had cover... if the contract is not valid then why bother signing anything...

No they dont, this would open up a can of worms of note.

The inter alia of the contract have not been defined properly, and one cannot repudiate a claim on the grounds of an interpretation.

There are general assumptions when it comes to contracts, these are normally based on the type of contract that the derived contract is based upon, and that may be what they are trying to milk here. The thing is though, that they will have to prove that there has been a precedent already set in a case of this type, and hence, if Grant can find a case where insurance has paid out under the same circumstances, he would have a good leg to stand on.

Clever. Accidents can happening anywhere. He was not part of any official racing, it was at a open track day. Driving fast in a controlled environment is not racing. :thumb:

Yes, I still got the diffuser, short shift, steering wheel, right hand side mirror cover and right splitter. If I decide to get an E30 body instead of an E81/87, I will let you know.

cool thanks mate im definitely interested in the steering wheel, diffuser and short shifter.
