BMW dealership obligations towards customer

Hi guys,

4 weeks ago I purchased a mint 2011 330d auto with 74k on the clock from a BMW dealership. The vehicle was on their showroom floor which is out of the ordinary for a vehicle as old as mine, but they claimed it was due to the low mileage, good condition etc. etc.

The vehicle was purchased with an electronic towbar which no longer operates, now they're having it fixed at their expense. Great.

Today I took the car for wheel balancing and alignment. The guy there told me the "stabalizer links" are worn.

Am I correct in saying that it is my right to have that sorted out and replaced by them?

From my understanding, with the CPA, you have six months to notify of any issues which may arise within those 6 months and demand repair, replacement or refund, unless it was a known fault which you agreed to at time of purchase.

I'm having a battle on my hands at the moment with a dealer who believes that his responsibility ended after 1 month of selling the vehicle. I'm trying to explain to him that the CPA implies a 6 month warranty from the selling dealer. I am now looking at my options.

74k km and you have suspension wear that 150k km cars doesn't have? That would raise serious concerns if it was me.

It's 6 years old. Materials deteriorate over time. It's a R1800 issue, so no need to have serious concerns.

You missing the point bud. You dont develop suspension wear at 74k km. At least not on an honest car.

It's 6 years old. Materials deteriorate over time. It's a R1800 issue, so no need to have serious concerns.

mine was a 2008 model,with 140 000km on it when I sold it, suspension was all fine and everything worked 100%,including electric towbar,i would also be concerned with only 74000km on it,shouldnt have any issues

Union Transport check and HPI was done by a personal friend, BMW history obviously checked by them, so I've honestly got no concerns about the mileage and the "honesty" of the car.

Please stick to the original discussion, or move on.

Was your advice at all aimed towards the main subject (the stabalizer links)?

With tha car as a whole I have no concerns apart from the towbar, which was dicontinued by Execuhitch due to the exact same problem I am experiencing with it.

In all your posts not a single point was made towards the stabalizer link, but instead towards the integrity and quality of my car, which was not being queried at all.

Stabiliser links don't go bad with only 74000km on the clock, get a second opinion from an actual mechanic. Tyre fitters and alignment guys aren't qualified technicians so I wouldn't take what they say as gospel.
Have you seen for yourself they are damaged? If they are indeed damaged then you need to dig deeper as you may find more than just damaged end links.

It's very fishy that end links are done with only 74000km on the clock. Sounds to me this car had an unreported accident or the previous owner drove on dirt roads for a living.

The guys are posting about the history and asking questions about it, because from some members previous experience with their own cars (Herrbmw) that had more kms, but yet none of these issues, the comparison was made.

It doesn't help you throw your dolls out the stroller and have a hissy fit about it.

The fact is maybe you should still be asking about the history of the car, and maybe somewhere something happened to the car that caused these issues, and by the guys here asking these questions and voicing their opinions it might just give you something to thing about.

Who knows...for all you know the car was in an accident, fixed without BMW knowing, and this might be why it's giving the issues it is...or maybe it jumped a curb....or maybe the previous owner did drag racing with it, thus the suspension is shot...maybe he was towing a 25ton trailer and that's why the tow bar is broken...who knows...

Fact is that the forum and its members are here as a family, and you should value their input and opinions, even if it doesn't always compliment your own view of things.

PS: you can email me as well the registration number, just for in case, and I will see on Enatis if I can see anything funny...

As much as I probably don't want to hear it I have now realized that there could possibly be some more investigation to be done into the car.

I'll possibly get a second opinion on the stabalizer links from a real mechanic instead of relying on the opinion of a tyre shop.

Look, it might be that the car hit a pothole that caused that damage. But best to have it all checked and verified.
