AARTO 33 - Notice of Summons to be issued ?

I am not even going to comment here, as it will cause an argument again about the legality of the summons, the fact that if you ignore it, it will go away... bla, bla, bla...

All these things have been asked and answered in the YOU v/s LAW thread.

I'll be surprised if you actually receive the summons. I have two of these but never got the summons. Couple of mates of mine, same story. In fact I dont know of anyone who has actually had a summons served on them recently. Maybe someone on here has,pls correct me if I'm wrong.

I said I wasn't going to comment... but clearly this is going to go the same route as in the YOU v/s LAW thread... :facepalm:

The notice you recieve in the mail is just that... a notice... to the fact that you were cought driving to fast, and that a summons is on route to you!

After that, you will either recieve a post office slip to go and sign for something at the post office, and this will be the summons sent via registered mail, OR you might get surprised one day in a roadblock, and arrested for not complying with the summons.

The reason for the arrest in the roadblock goes as follows...

By law you HAVE to keep your adress details up to date at all times. So your place of residence is taken as if the summons has been delivered to you!! So not going to the post office to sign, or simply ignoring the notices, will only land you in trouble!!

TRUST me on this fact!!

The BEST you can do, and ask some of the forum members on here that has indeed followed my advice... is to GO AND SORT IT OUT THE RIGHT WAY!!

Go and write a letter of representation to explain your case!! Go and speak to a prosecutor BEFORE the trail date!! This way, an amount can be implimented, and you can pay the fine!!

Now... I REALLY hope this advice is taken, and PLEASE don't listen to ANYONE telling you to ignore it!!! :thumbdo:

Francois, with AARTO it has changed slightly. The Sheriff will rock up at your house one day and start attaching your valuables, like your flat screen tv, iPad, lawnmower, fridge and freezer... Get my drift. They will then sell these items on auction to recoup their costs, legal fees and the actual fine with interest et all.
Only if you are accused of negligent and/or reckless driving will you be subjected to the criminal law.
What do you say Cois?

Hmmmm that's stuuuupid....

That means taxi drivers will not own anything beside their taxi....

Morne, that might very well be true!!

The fact is like I said... your adress is taken almost as if it is you, and thus it is excepted that the notice was delivered and recieved, and thus judgements can be issued accordingly, like the repo order you are refering to.

I agree, I am not saying ignore it, but you can only do this once you have received your SUMMONS. Until you have a court date you can stand on your head at any cop shop or court, there's nothing you can do until you are actually SUMMONSED (?). Trust me, I've tried. What I am saying is that correct address or not, I dont know of anyone that has actually got their SUMMONS, not a warning letter.Please prove me wrong, has anyone recieved an actual SUMMONS following one of these warning letters?

Chef, you're clearly not in the gardenroute area alot. Mossel bay they almost always trap on the N2 where they can sit in the middle of the road between two bushes so you only know they're there until you're almost next to them.

George they trap often on kaaimans pass (N2) (definitely spelled that wrong) and george probably has more fixed cameras than the whole of cape town.

In between knysna, sedgefield and wilderness on the N2 they have 3 of those small green boxes which they can move to various fixed locations apparently they trap both lanes. And then they have another camera sometimes used coming into knysna going around the lagoon, or just before coming into knysna around a downhill and a bend.

But on topic there is a camera in plett going down to beacon isle hotel, that is in a 40km zone (no houses on this road), I was told by a taxi driver that it was illegal to trap under 60 as it was an urban area and the camera only goes off after 60.

Oh and although its never happened to me they have trapped people in a closed estate for going over the speed limit I think it was 30 lol. Pretty sure its illegal. I would have made them give chase in my estate lol.

Kaaimans (spelled correctly) has fixed cameras, I know. One lane 60, the other lane 40.

I used to live there.

I know George has all those cameras, but the whole town is a 60 zone.

I was talking about the highways between George and Mossel Bay itself, in and around Grootbrak, Kleinbrak, Hartenbos, Herold's Bay etc. Only ever seen them trapping in the N2 during December, nailing all the vaalies on holiday.

Things have obviously changed I lived in knysna for many years and still go back a couple of times a year.

There are 2 fixed cameras on kaaimans, they sometimes trap at the dip behind a sign also they sit where you can park and go on the walkway under the bridge and trap you from behind.

They trap fairly frequently between george and mossel bay these days and like i said they sit between the bushes.

George is probably one of my least favorite place to drive with its 4 million 4-way stops.

i got one by mail and was due for court 2days ago
but then i again received a notice for the same transgration to pay R1200.00

was doing 140km in a 80km zone on the N12

was advised that if the summonds was not hand delivered and sighned for it can be assumed that i received it and that was my third one in 5years just saying :argh:

oookay so update on my escapades.... went to malbro traffic dept and the prosecutor was no where to be seen for ova 30 mins... after asking around I get told that I need to goto the Randburg Magistrate's court.

so I go to the court and after a lengthy search finally get sent to the traffic prosecutor, who looks at the notice and asks why am I here b4 the summons :argh:

he then tells me to come and see him with the summons b4 the court date

I did the same thing with the very same prosecutor at the very same court with the very same outcome... I was told to sit tight until the official summons is received, which according to him could take over a year... what a process, I was there admitting guilt and offering to pay, but they would rather waste time and admin for setting up a court date only then allowing you to come in before the date and settle the fine. :facepalm:

Until you have a court date you can stand on your head at any cop shop or court, there's nothing you can do until you are actually SUMMONSED (?). Trust me, I've tried.
I'm in the same boat, bud.
