Road Worthy Certificate

Hi guys,

So I bought a vehicle from BMW less than two months back, and I have had endless issues with the dealership as stated in another post.

So I have reason to believe that the car had not actually been for roadworthy, so today I asked for a copy of the RWC and this is the response I got:

"Good Morning Nevashen ,

I trust this mail finds you in good health and spirit.

I am well thanks ,

We do not receive roadworthy certificates , However I have attached a copy your NATIS document and License disk. I have requested for a certificate from the test centre. "

Is that possible? is the roadworthy not required to re-register a vehicle?

any advice?

So from my experience, if the car has been transfered to your name and registered then it definately went for roadworthy. The physical certificate doesn't need to be sent to the liscensing office as they have it already electronically stored in eNatis from the test station.

However the test station usually gives you a printout as well so the dealership either has the printout or they can get another one from the test station.

For a long list of reasons, I think the car never actually went to the testing station because of faults on the suspension from day 1.

Dealerships usually make friends with someone at certain testing station that will just rubber stamp their certificates for them....so even if it has the certificate does not mean it is actually roadworthy.

I agree with Johannes. Most of the time the car doesn't even leave the dealership.

Some cars get roadworthy certificates issued while the car never leaves the dealer floor. It's all about the dealers "friends" at the testing stations.

If they gave you a new license disk then the car went for roadworthy. You can transfer a car into your/someone else's name without a roadworthy but you will not be given a new license disk and will only be able to get the new license disk once the car has been for a roadworthy.:thumbs:

If they gave you a new license disk then the car went for roadworthy. You can transfer a car into your/someone else's name without a roadworthy but you will not be given a new license disk and will only be able to get the new license disk once the car has been for a roadworthy.:thumbs:

I also think its valid for 6 or 3 months:fence look: so you may not need to retest as this will be on the Natis system.

well guys I think the car had "roadworthy" done but never actually left the dealership because I found out that after dropping the vehicle off the on Thursday, that the struts are damaged and that the power steering pump needs to be replaced.

I don't think the power steering pump would have made a difference to the roadworthy, but damaged struts would have. How the hell do the struts gets damaged on a car that's only 3years old? WTF

Do I have any recourse would the dealership if they have "faked" the roadworthy?

You'd have to get lawyers involved. Chances are your car never went through roadworthy test. But a genuine "bullshit" certificate can be issued saying all is well... if they know the right people.

But... if on finance, you can threaten the dealership that you will want to cancel the finance deal. Contact your bank stating why - do it anyway since i doubt you will want to deal with that dealership again. The dealership will jump, as they wont want to get kicked out of the banks panel for misconduct (touchy subject with banks these days) AND C.O.R. fraud is major problem that a bank & dealer wont want heat on.

Get a quote on repairs to sort your car out independently at an RMI approved workshop atleast. Take that to the dealer. Tell them to pay you to get it fixed and no other claims will be brought to them. CPA rules basically say "If any defects are discovered with six (6) months of the sale you have the right to insist on repair, replacement or a refund. This is your choice as the buyer."

I had similar issue with a car i bought at Club Motors Randburg. Only found out 8 months later when i had to renew my license disc. I had to do roadworthy from Private Roadworthy center and claimed from the dealer. i still dont understand how the vehicle was financed and registered without a valid roadworthy certificate.

So last week I requested the RWC and I have not received it yet but both the dealer principle and salesman assured me that the car had been for Roadworthy.

The car has been with them for almost an entire week now and the list currently goes like this. The car is still on motorplan
Damaged Struts
Replaced Fuel Pump
Replaced Power Steering Pump
Replaced Bushes.

They still had the audacity to ask me for R200 for fuel.

Im so frustrated because it seems like this car never went through a quality check or a roadworthy and I am so pissed off.

This is on a BMW premium selection Vehicle. I am waiting for them to give me the full list of whats being sorted on the vehicle and then I will contact BMW financial services and tell them that they can request their money back from the dealership based on the above.

That's crazy man, sorry for your issues. I would park the car at their dealership and cancel the finance agreement.

the car is currently at the dealership and I am gonna call BMW finance tomorrow to find out what I can do.

what is the point of buying BMW premium selection when it doesn't even go through the quality check.:argh:
