Legal Advice needed - RWC

On 12 Oktober 2012 I picked up my 2009 X5 35d from Primo Executive Motors in Edenvale. Due to them not being ready at the agreed time, I had to sit in their waiting room for nearly 4 hours (my lift already left). After 3 weeks of promises I still haven't received my registration papers and only found out in week four that the road worthy test was never done. So we agreed on a date and time and I took it back to Edenvale all the way from Pretoria. The very smooth salesman, Paolo, directed me to the test centre around the corner and I took it there myself.

After the test, the centre said that the right rear tyre is not up to standard and I need to take the car back to the dealer as they cannot issue the RWC. Once again the smooth talking Paolo said I can leave with the car and that they will sort it out. Because I had an urgent meeting back in Pretoria, I deceided to leave, knowing very well that they basically want to bribe the centre in giving them the RWC. Now, nearly 8 weeks after I picked up the car, I still don't have a licence disc or RWC.

To top it all, I got a flat with that very same tyre on Saturday, the day before I went on holiday (with a caravan!). I had it replaced the same day, but the people at HiQ were quite shocked with regards to the condition of the tyre.

I will contact Primo again, but first I would like to know: should they tell me that the RWC and license disc was issued, who can I contact, because I see this as a serious case of fraud and a total disregard for the whole idea of road worthiness. I know that I will definately inform Wesbank, as the finance was done through them, so they are a major stakeholder.

Your input will be much appreciated!

From my understanding wesbank would not finance a vehicle without the RWC as they are the title holders.

I would throw the new consumer act around, it should wake them up quickly...the new law is for the consumer, no longer the seller - its in place to prevent stuff like this happening at all levels.

Its shocking...but reality - anywhere in the world....everyone is waiting around the corner to screw you dry, no vaseline!

Hope you ge that all sorted soon. Have the dealer also fork out the cash for the tyre you replaced.

I Agree with JayDrft,

I would also suggest to call legalwise, they give great (free) legal advise, at least you would know what route to take, but if I were in your shoes I would cancel the deal and get another one from another dealer (If there is no RWC then they clearly bribed someone, and still in breach of contract? Seeing that it's not a true ROAD WORTHY certificate)

My whole buying experience was a bad one. I only got the car a week afterthe initial delivery date - got postponed all the time. Then the 4 hours waiting on the actual delivery date. There was NO diesel in the tank on delivery, when I stopped at the first garage 1km down the road, the range was on -5km. The car was not very clean. There was no spare key, although they promised to get one, but for that they need the registration papers!

I won't buy from them again!

Personally I would take the car back and demand my money back. Sounds like a bunch of scumbag criminals.

It would be nice to see what they are up to.

It sounds criminal and they keep avoiding the issue.

That is a major disappointment. They have an alpine white X6M listed on auto trader that my dad has contacted them about. Mileage is 41,000kms on the site and priced at 820k only to find out the mileage is really 56,000kms and the car is being used by the director's wife daily (car's price hasn't changed).

Thank goodness for social networking, we're steering clear and looking for a reputable dealer with a genuine X6.

After an email to Wesbank informing them of my situation, the owner called me to apologise. The salesman is no longer working for them. I took my car back for the test and they said they will send me my licence disk. The owner also offered to refund me for the tyre.

At least they came to the party in the end, but it was still not the service that I expected initially.

Heard the guy you dealt with caused a lot of trouble while he was there, seems like the other guys are more willing and able.
