Ralf, the person, as in the victim, will be detained and charged for the shooting, and there will be a few charges...
1. Use of a firearm/deadly weapon
2. Manslaughter
I don't think he will sleep in the cells, but bail will be payable, and the person allowed to go if he has proof of permanent residency.
It will then be up to the courts to decide if it was in self/private defence, and if the shooting was in fact justified.
In this video, it is clear the hijacker also had a firearm, but the courts are full of nonsense, and can argue that instead of shooting the suspect, the victim could have tried to drive off... I know, but yea, that will happen...
Shooting someone should always be the last resort, and in my instance, I felt it wasn't necessary to actually pull the trigger, as the guys clearly got a fright and ran, BUT that being said, HAD I in fact pulled the trigger, and shot the one with the knife, I would most likely have gotten off under the Private defence clause, as the attack was imminent and the thread on my life real, thus allowing me to use deadly force.
