Well now if that's the case, it's been a few time stopped by the road during random routine check, now a few times they ask me to get out of my car and they want to go 'test drive' my car to see if is road worthy... so must I obey that:fencelook:

Surely he can't order you to do something illegal.

I'm guessing he can only order you to do something which is contrary to the laws he is appointed to enforce ie road traffic act but not contrary to other higher laws ie the constitution

Nope, they can only drive your car if it was used to commit a crime. For example, if you were caught speeding at 50km/h over the speed limit and they arrest you for reckless and negligent driving, are they allowed to drive your car. They cannot use your personal property without your permission, unless it was used to commit a crime, and they seize your vehicle.

Coisman, please check if I'm correct.

Yes it makes sense, that's why in this country is so difficult to enforce anything. Now granted, not all drivers follow road rules and some law enforcer also taking chances and don't follow the law, so it comes down to how you response to the law enforcer and also depending on how their moods are at that current moment:blab:

Yes it makes sense, that's why in this country is so difficult to enforce anything. Whenever you are arrested, so not just for speeding, just to be more clear.

It might also be , like we get allot here in town, when you abandon your car, like in hit and run, or when a taxi gets pulled over and the driver knows he has warrants outstanding and he runs away, and leaves the vehicle abandoned, then we are also allowed to drive your car to the pound.

We are also allowed to drive your car to perform a roadworthy test on the brakes... so if I feel that your cars brakes might not work properly, I can instruct you to have me drive the car and perform a brake test to see if the car is working fine.

Now in this instance you can become "hardegat" and refuse, forcing the officer to refer you to a testing station where the test can be done on proper machines, and not by and officer out for a joyride... which I have NEVER done!!! :mmm:

In a case like that where I havent commited a crime, and you as a cop are doing your job based on what you may or may not have been taught, and then wanting to drive my car to confirm your thoughts (brakes test as an example), I would rather spend a day in a queue for a roadworthy test, based on the following:

1) I dont know how good you are as a driver.

2) anything can happen behind the wheel. What if someone bumps into my car while you are driving/testing it?
