NOTICE


Dear Members,

We always appreciate concerns or issues raised and can ensure you that such concerns do receive the Staff’s attention. A concern is discussed and consulted amongst mods and admin and a decision will be made.

We do, however, wish to bring certain matters to your attention.

Forum Rules, Terms and Conditions

For ease of reference, we refer you to the below terms to which you all agree when you access the BMWFanatics platform, namely:

Paragraph 8
Personal attacks, rudeness, flaming, baiting, insults to others, or arguments will not be tolerated. Challenge others’ points of view and opinions, but do so respectfully and thoughtfully. Please refrain from making excessive negative comments. As the saying goes "If you have nothing nice to say then don't say it".

Paragraph 9
Any member who threatens anyone on the forum, via PM, instant messengers, or Email, will be banned immediately without notice. We reserve the right to remove offensive posts without notice. Our decision is final in these matters.

Paragraph 10
Please do not question or discuss moderation or administrative decisions on the forum. If you have a query, then please PM a moderator or administrator in this regard.

Paragraph 11
If you feel you were treated unfairly by a moderator and wish to complain about them, then please contact one of the forum administrators or via email: [email protected]

Paragraph 12
If you break the forum rules in any way, or commit an act or omission which may be considered detrimental to the Forum in any way whatsoever, you may be dealt with accordingly in the sole and absolute discretion of the Site administrator. This can range from deregistration, suspension, or a ban and may range from a few days, weeks, months or may be of a permanent nature. Normally you will receive at least one warning before any action is taken. If you repeatedly break the same rule your account will be at risk of an extended (several months) suspension or even a permanent ban.

The administrator of the site has full authority and discretion to exercise these rights and may exercise these rights with immediate effect if he deems it necessary and no notice will be required.

Paragraph 22
While these rules cover most common situations, they cannot anticipate everything. Consequently, we reserve the right to take any actions we deem appropriate to ensure these forums are not disrupted or abused in any way.

Paragraph 31
We have the right to suspend, remove, expel, or disqualify any party from participation and access to the Forum for any time and for any reason, in our sole and absolute discretion. This includes, but is not limited to any violation of this agreement, disruptive behaviour, and complaints from other parties, any allegedly illegal activity.

You are again reminded to familiarise with the terms of use of this platform.

Moderators and Administrators
As most of you should be aware, and as many previously appointed moderators and administrators are aware, the current moderators and administrators receive no benefit, remuneration or other like for attending to their duties bestowed on them. All of these members take time out of their day, which they could have spent with their families, friends, relatives, etc. to ensure that you have a pleasurable experience when accessing the platform.

Most of the time, these persons are expected to drop their day to day duties, and work-related duties, to attend to matters pertaining to the BMWFanatics platform.

Those who experienced this as previous moderators and administrators know how much time each matter needs to be resolved, many instances spanning over days.

As previously noted, it is against the rules of the BMWFanatics platform (paragraph 10) to discuss moderators, administrators and their decisions on the BMWFanatics platform. This is not to discourage valid concerns, but to keep in the spirit of mutual respect, consideration and common decency which are reflected in all the rules of the BMWFanatics platform. You may, in any event, refer any concern to the moderators and/or administrators for consideration.

BMWFanatics Platform
It is important that we consider the purpose of this platform. It was created more than 10 years ago to unit all lovers of BMW automobiles and other car manufacturers. South Africa is a diverse country and we have through decades learnt to respect each other and approach any sensitive issue with great consideration of any persons involved in such discussion.

Having said that, this forum, its members and its appointed staff, are not judge, jury and executioner. The Staff are merely guided by the terms and powers conferred to them through such terms (to which each and every member agrees when accessing the BMWFanatics Platform).

Therefore, the Staff’s main aim is to protect the platform first and foremost. This is in accordance with the powers and responsibilities bestowed upon them.

If a legal dispute arises, the Staff’s main concern relates to the accountability of the platform itself. Any dispute between third parties are to be resolved by such parties between them.

If a dispute requires civil action, then the parties must do so in accordance with the laws of the Republic of South Africa. If any civil claim has prescribed by virtue of prescription, then it is the responsibility of the claimant to lay a criminal charge.

It is not the responsibility of the BMWFanatics Platform, or it’s Staff, to resolve disputes between parties. This is not an alternative dispute forum.

Having said that, the powers and responsibilities bestowed upon the Staff members requires them to always act in the best interest of the forum. If any happening brings the platform into disrepute, they must act accordingly to protect the forum. The same relates to any contravention of the rules (this includes any disrespectful behaviour towards other members and staff).

Conclusion
We understand that many of our members are enthusiastic persons who love the BMW brand and are always looking out for fellow members. We are forever thankful that we have the opportunity to have such a close-knit community of people all in one place.

We hope that whatever action is taken that you respect it, as an action will only be taken in accordance with the relevant rules applicable to the BMWFanatics platform.

The staff cannot do more than this.

Every matter, especially highly emotional driven matters must be considered carefully and with the necessary circumspect to ensure that the platform is protected.

We trust that you will appreciate that in some instances, these decisions do require consultation with the staff members as a whole, and even considering legal advice that we receive.

We thank you for your patience and request that all members adhere to the rules.
