e92 m3 motor plan cancelled

Hi guys, my M3 has picked up a bearing knock and bmw head office refuses to pay for the claim or replace engine in my car. They say the car was over revved about 2000km ago. Car does not have and never had software done to it at all. They say my motor plan will remain active but they are not gonna cover me for any major repairs like engine, gearbox and diff. I need some advice on how to handle this cause I can't take a loss for a car that has no modifications done to it and also why didn't they just cancel the entire plan instead of keeping it half active?

:sorry: to hear that man, maybe someone else has a resolve for you. Theres always a story from BMW SA when one's car is in warranty and they want to claim. This puts a lot of people away from buying beemers.

Ask them for proof.

BMW has a policy that any car that has the rev or speed limiter exceeded, they will immediately cancel the MP, however you can ask for proof.

When I asked for proof yesterday they said they can only give me the graphs as proof only if they receive summons. But let's just say they do manage to prove that I over revved the car by means of a miss shift cause obviously limiter will stop the engine when upshifting, can they cancel plan for a miss shift?

Its a performance car its meant to be driven hard.

On another note is the bearing knock issue also common on this version of the M3?

Clearly NO

First thing you MUST do is to object to the cancellation immediately in writing!
Demand that they send the ECU to Germany to investigate and have a report issued!
In the meantime they HAVE TO give you a replacement ECU so you can drive the car.

I dont understand how a standard car can over rev. Did you buy the car new or second hand?

If as you say the car has never had software, I would be going mad in their office with a bs story like this! :thumbdo:

If you keep your foot on the gas and change near the limiter it will cause an over rev.

@Sash,are you the first owner of the vehicle?

To my knowledge so far, I believe it is a common fault also.

A DCT can never over rev.. The software will not allow incorrect gear selection at any time!
A manual can over rev, say if you change from 5th to 2nd - by mistake. (at high revs)
Even though you have a rev limiter, a missshift from 5th to second will force the engine speed to conform the wheel speed for that gear, as they are connected mechanically.

Bought it second hand, but have it for like 30 000km after purchasing it and they say its showing over rev 2000kms ago, so that means it only happen in my possession. So as u say about keeping foot on the gas near limiter then changing, can they cancel plan for that?
