I'm curious - let's say you buy a car which has software mods on it and BMW does the quality check without picking it up. Surely there is no way that they can refute a claim afterwards if they discover it.

You give them hell for it. That's what happens next.

Are they able to pick up when the sw was loaded...bit of chicken and egg with the owner getting screwed if they can't :fencelook:

well surely if they do the checks when transferring the MP (which I doubt they do), they would have picked it up. so it will be on them as well to prove you fitted it after you bought it, which a system check should be able to verify.

Very interesting debate. Because let's put it this way, I personally will never buy a car that I know or suspect has been modified! As we all know, tuners can work miracles but many can do the opposite and wreck perfectly reliable cars!

But certainly a car bought while still under motorplan one would expect and hope that they are completely un-fiddled with! Older cars out of motorplan is obviously a different story and up to the buyer to investigate and pick up on these things!
