Accident Damaged

Hi guys

I just bought (1 month ago) an E90 320D with 50K on the clock from a BMW deeler in CPT. It's a 2006 car and I got it at a VERY good price which made me a little suspect so when purchasing I investigated the history as much as I could but it came up clear. To cut a long story short I noticed body filler on the right from door and took the car to Auto Atlantic Couchworks for inspection where I was told in no uncertain terms that the car has been in some form of accident (there is a panel that is quite badly misaligned though along with the body filler).

My concerns are:
1.) Safety of my family and myself - Could this accident in anyway affect the stucture of the car?
2.) My resale value when selling - If the damage is indeed repaired by BMW it will go onto the car's record and therefore be something the dealer will try slamming me on when trading in.

The BMW dealership where I bought the car was aware of the accident damage when buying the car in from the original owner but did not disclose this to me. They are willing to have the car professional repaired to BMW spec by Coachworks or offer me a replacement car. I really like this car though and would prefer to keep it but do worry about the two points mentioned above.

Anyone have suggestions for me?

The dealer, if an original bmw dealer should have disclosed it. :nono:
Also it appears that the car is still under motorplan, so contact them as well. :thumb:
If the car was in an accident, :censored: then the motorplan should have been voided, :dropjaw: till proper repair and inspection was done on it.
I would opt for the replacement, but if they are willing to send it to an approved bmw workshop, and fix it properly, then why not. :dunno:
But do contact the bmw motorplan people ASAP tomorrow, that's what I would do, and hear what they say. :thumb:
Good luck

Hi Andy, are you the person that bought the e90 from SMG in Century city?

If you are, then I've heard of you(your car).

anyways, according to the BMW checklist for premium selection cars:

Checklist.
BMW Premium Selection.
Full service history.
Next applicable service, if necessary, is carried out.
Accident and body check for visible signs of accident damage.
Check paint for defects.
Minimum 3mm of tread across the entire width, including the spare wheel.
Check the complete brake system.
Check shock absorbers for leaks and replace if necessary.
Check battery condition.
Check all electrical systems.
Electric mirrors, windows, sunroof, central locking and interior lights all in full working order.
Check that seat belts meet all legal requirements.
All fluid levels to BMW Group specifications.
Check clutch, brakes and transmission for correct operation.
Check that wiper blades and washing system are operating correctly.
Test drive for performance and noise.

http://www.bmw.co.za/products/automobiles/premium_selection/checklist.asp

it is right that they offer you a replacement or a gauranteed repair. Also, according to the consumer law, they have deliberately withheld information about the car which would have impacted your decision on buying the car in the first place (sound like 'fraud' to me).

Dude, rather look at your options. At the moment your thinking is based on pure emotion. A year or two from now you may regret not checking your options and taking the dealer to task.

Hi Nate.

Oh no mate, I certainly am taking them to task over this.
I'm busy writing a letter to the Dealer Principle and if I don't feel 100% satisfied I'll certainly let BMW SA know all about it.

Thank you all for the help so far.

The re-sale value will drop, I know my brother had hail damage repaired on his 320 and when he traded it in they offered him R20k less than they would have given him if there was no hail damage repair. Basically the repair was loaded onto the BMW system. So if there are any comments on the BMW system about yo9ur car, expect less when you trade it.

This is poor form on the dealers part.

Considering what I was offered as a trade in value on my car by said dealership, I'm not nearly as impressed with them as I used to be. Another BMW dealership in the foreshore (I wont mention their name  ) offered me almost 30k more on trade in, and you simply cannot tell me that it was purely dependant on the vehicle I was interested in.
