2013 X1 2.0D S DRIVE M SPORT DAMAGE

Hi Guys. the support and insight on this forum is amazing. thanks to everyone that helps make this forum what it is.

Not sure where to post but i just wanted to share my story. I have a 2013 X1 2.0D S DRIVE MSPORT with sports auto trans. I just recently bought the vehicle 5 months ago and it was an immaculate vehicle and surprisingly hard to find diesel msport X1s. Anyway after i managed to find a clean example and it had to be m sport and pano roof with xenons(with the white angel eyes).

I was really enjoying the vehicle and just when things were going well....BAM... I was driving in Sandton and a delivery driver on a scooter jumped the robot and hit the front left side of my vehicle, the driver ended bouncing off my windscreen and was taken to hospital. Anyways he was not insured and I was with King Price. 38 days after submitting my claim and giving me the run around KP rejected my claim as I am not listed as the regular driver. Now its going to be a long battle to fight KP and one that shall cost a lot of money.

Im not sure what to do. Do i spend money to fight KP or just cut my losses and repair the vehicle myself or sell it as it is (LOL make me a serious offer). The vehicle still drives well (i actually drove it home after the incident without any issues) The damage seems to be mainly cosmetic. Looks like all i need is a windscreen, fender and side mirror and some panel beating.

Any suggestions where can i get parts at a good price, a good but not expensive repair shop etc?

Fight them all the way to the ombudsman! BS reason to reject the claim unless you had a specific restriction to one driver (or named drivers). You're the second insured fanatic in a short space of time forced to pay out of pocket! It's so annoying to see this.

I doubt it is going to be feasible to sell as is without taking a HUGE knock but you could look at repairing yourself if all else fails.

Try getting a quote from Auto Body Specialists in Midrand for purposes of the fight and to assess the damage to roof/A-pillar etc. Check out Khaya Lami Autobody if looking for a more cost effective repair (they can source the used parts IIRC - another mate used them and had good things to say for their repair work)

Thanks for the suggestions. From my research the ombudsman does not seem to help in South Africa. A lot of people say all they do is foward your response to your insurer and then foward the insurers response back. The only legal option would be to go to court but woud it not cost the same to just repair the vehicle :unsure:. I shall give the panel shops a try.

Even if you are not the regular driver, you should be covered if the regular driver (as listed on the policy) gave you permission to drive the car.

Sorry about your loss. I would fight the insurance all the way!

From the pictures, you are going to sit with a hefty repair bill. I cannot think that this repair will come in under R100k if you use new OEM parts and a decent panel shop.

This is terrible, sorry dude. Insurance claim against the company the driver works for will be an option.

Secondly, check the Ts & Cs in the insurance policy, no way the claim can be outright rejected UNLESS you or th epolicy holder have agreed to specific terms and conditions around the policy to which you have not really discussed here.

We all say fight the insurance but please consider how you concluded and agreed on your policy as this could end up costing so much for the fight, where you should know already if its a losing battle (@KashR will help you here).

Good luck man, it sucks to have this happen, had the same on my 320d, within a week of ownership, serviced and full tank of diesel and a biker hits me and lands on my windscreen and also dented the roof. The repair bill is insane for OEM parts but also consider, the damage the roof would have taken will inflate the costs even if it cannot be seen.
