Good day all

*rant incoming*

So the past weekend my car door was dented by a lady (hereafter referred to as teef) opening her door and not paying attention to the wind. Luckily I just pulled into the parking spot so I was in the car as it happened. She was very apologetic and gave me all her details and stated: "Don't worry my insurance will sort it out". I took photos and left the scene.

Come Monday I contacted her and she gave me her brokers details as well stating "he will assist you further". On Wednesday out of the blue, the teefs broker advised me they are not going ahead with the claim because "Their client does not feel comfortable with me claiming from them anymore because it was an accident and therefore she cannot be held liable and suggest I inform my insurance." That is the most bullshit story I have ever heard in my life. Yes, it was probably an accident but most certainly are you liable for it.

I understand that is what my insurance is for, but firstly I refuse to pay the excess and risk my clean insurance history for something that is not my fault. The damage is only R1000 for the dent removal and my excess is R4000. So not worth it. I'm considering just paying for it, but I'm sour (and quite pissed) because the teef just up and decided "Nah I'm not paying for this". I bypassed her broker and phoned her insurance directly, but they need a policy number and the broker and the teef is not willing to give me this info.

Has anyone been through this to give me any reasonable suggestions? I have not quite calmed down as yet so I'm still considering driving to her work every day and keying her car.

By law you are not allowed to claim against someone's else insurance if you are insured.

Have you called one of those paintless dent removal guys, maybe they can take the dent out for less then a R1000, get a quote, send it to teef and ask if she's willing to split the costs, it's not ideal, but its better then nothing, not so?

She wants nothing to do with it now. She literally just decided she's innocent and I must sort it out myself.

@Zack, remember the law is never on your side.... What do think insurance companies do? They take your premiums, payout your claims(repudiate where they can) but thereafter they have their teams that go searching for remuneration from those offending people / insurance companies etc etc...

What's the definition of third party insurance? I was under the impression it allowed me to claim from the other person's insurance. I have done more than once even though I have my own insurance. I always informed the other insurance company as well as mine of a third party claim and all went well. Who was wrong?

I have always claimed from my insurance then they claim back from the other party and refund my excess. People suck. Trust nobody in cases like this

Reasonable suggestion incoming...

Go to the police, open an accident report, and lay a case. You'll basically be able to extract the money or at least the he effort of a court appearance will persuade her to just pay it.

Basically you could threaten her with small claims court, or at least get your money though the small claims process, being only R1000 in damages, I'm sure she's just pony up the money.

The key here is to do it as soon as possible, the longer you take from the day of the incident the weaker foot you have to stand on.

This is actually what frustrates me. It all seems so petty to go through the court process for R1000 in damages. In that mindset, I tell myself to just pay it and forget about it and be the better person. The wheel turns right?

But then frustration sets in and I wonder why people think they are better than others that grants them authority to do things like this. dunno anymore

You would have to make a case against her. She sounds like a real bitch. It would never be worth all the effort for only a R1000. However I can’t stand people getting away with this shit and would spend R10k of my own cash to make sure this teefs life becomes hell or she pays up. A lot of kuk people in this world unfortunately.

Do what I did and this made feel better even though it was wrong.

Once I was parked at our local Nando's waiting for my order. While sitting in my car, the guy next to me opens his door onto mine. his drivers door onto my passengers door. He looks at me and walks away.

After picking up me order I casually went to my passenger side left my food on the seat, closed my door and booted his door all in one motion. Leaving a sizable dent. Needless to say I felt no qualms for the mother...…. Even the car guard commended my efforts. smile bounce

Some people have no decency at all.

I am completely against damaging another person's car, under most circumstances. This situation would fall out of most circumstances and I would abandon my usual thought process.

I would get my own back and then fix my dent. You tried the correct way, that's what counts.. Thumbs

My car was like two months old. While getting dog food at a tiny little strip mall. I got back to my car and had a chunk of paint missing just above my rear wheel.

Ended up costing me R2000 and I wasn't able to find the person responsible. Just must have drove away. No car guards saw it either.

Hi. Sad to hear about that. However, there are still good people out there. A few weeks back, my wife was at the mall and when she came back to the car, there was a ding on the back bumper and right fender. The lady left a note on the windscreen with her details. I called her and thanked her for her honesty. She referred me to her insurance who requested the relevant info and they paid the money. I didnt have to go to the police station or involve my insurance. smile bounce

Annoys the f*** out of me when this happens. With me working in a mall with no dedicated staff parking, i try as much as possible not to park the car at work but its not always possible. Last week some f*** dented the door and theres now paint missing and as usual security didnt see anything not that i expect them to. Pains me that someone would do that and just drive away. Karma is a bitch though. Last time this family in a fortuner squeezes into a parking next to me while im waiting for the wife to pick up our takeaway, and this guys kid opens his door onto the passenger side rear door of my car, i confront him and he says his not liable as accidents happen and its just a kid. It was late so wasn't in the mood for a scene. Told wifey what happened, she says dont worry, give me the house key, opens her door holds the key against the fortuner and tells me to reverse, left a nice long scratch on the fortuner, felt good honestly. smile bounce
