Legalities of no front plate?
Whatsup the fellas!

So a cop told me on the weekend he can impound my car, under the new regulations for not displaying a front number plate (my rear is always on + license disk always valid ).

Is this true?
What are the exact legalities around this?

I know the best would be to permanently affix a front number plate and the forum doesn't condone this kind of behavior bla bla bla...... :-)

Could the lawyers perhaps clarify this for me?

would also like to know...had my disc pulled for not displaying my plate...was in the windscreen...friend said something interesting...says he doesn't put it there as it draws attention...it catches their eye. I plan to still drive without plates on the audi and Datsun so want to know if they can do that.

"All vehicles in South Africa, excluding motorcycles, are required to display a number plate on the front and the rear of the vehicle. For vehicles that cannot accommodate a full size plate in front, a plate with smaller dimensions may be fitted with permission from the registering authority."

i dont think there is a work around, you might be lucky to be stopped by a copper that needs a coke tho...

I think (IMHO) that the difference would be with the definition in the regulations between
1) Unroadworthy
vs
2) An offence

If a lack of number plate (in the regulation) classifies the car as Unroadworthy/Unsafe/Hazard to safety and life, then impounding would be legal

Or

Is the lack of a number plate seen as an offence, or worse a criminal offence such as "Defeating the ends of justice"

Last time i checked:

No front Plate = R1000 fine
No Rear Plate = R1000 fine

No front and rear plate = impound vehicle.

So I found this on the National Road Traffic Regulations:

Quote:148. Notice in terms of section 44 of Act to discontinue operation of
motor vehicle
(1) A traffic officer, or examiner of vehicles acting in conjunction with a traffic
officer, may in terms of section 44 of the Act issue a notice on form NTD as shown in
Schedule 2, to direct that a vehicle shall not be operated on a public road or only be
operated on a public road upon the conditions prescribed in subregulation (2), in which
event he or she shall remove and destroy the licence disc or licence and roadworthy
certificate disc of the motor vehicle.
(2) The said notice may contain conditions to the effect that the vehicle may be
operated on a public road for a specified period, which may not exceed 14 days,
subject to limitations with respect to speed, route or any other limitation determined
by the traffic officer, or examiner of vehicles acting in conjunction with a traffic officer.
(3) The traffic officer, or examiner of vehicles acting in conjunction with a
traffic officer, shall ensure that the particulars of the vehicle concerned is updated in
the register of motor vehicles to the effect that a notice in terms of section 44 of the
Act has been issued with respect to the vehicle, that the vehicle may not be operated
on a public road and that the vehicle does not comply with the requirements for
certification of roadworthiness.
(4) The motor vehicle concerned shall be taken to a testing station where the
vehicle shall be dealt with in the manner contemplated in regulations 139, 140 and
141.

Cois would be able to word it better. But driving without a plate will technically only get you a fine. However, if you catch one on a bad day they will make an argument that your car is not roadworthy and pull your disk and make threats about impounding. Because lets be honest, what can you really do if he tells you this if you know legally you are in the wrong? Fencelook

As per the new system:

Driving a vehicle with a licence plate not visible: R500 1 demerit point . This basically means you will get 12x stops per year (if you have no other offences) and then your licence is suspended for a month. 3x suspensions and your licence is cancelled.

Some people don't ride because they want to live. I ride because I want to live a little more...

Solely because a clean front looks so damn good on our cars. It's not for everyone though, some cars have ugly fronts and behinds

As I have it they can only impound the vehicle if no plates and no disk, because there is no way to prove that the vehicle is indeed registered or belongs to you, or if it is found to be unroadworthy. So it all depends on the cop if he feels no front plate would make is unroadwothy.

na look i dont know of a single person who has had their car impounded for not displaying the front plate...fines & discs removed sure....the OP raised this because of the new system.
